The Hampden Bush Cemetery Order 1964

At the Government House at Wellington this 22nd day of April 1964
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Cemeteries Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER
-
(1) This order may be cited as the Hampden Bush Cemetery Order 1964.
(2) This order shall come into force on the 1st day of May 1964. -
The Waipawa County Council is hereby appointed to be the trustee of the Hampden Bush Cemetery, being the area described in the Schedule hereto, and shall have the control and management of that cemetery under and for the purposes of the Cemeteries Act 1908.

(1) The delegation to the Waipawa County Council of the powers of appointing and removing trustees of the said cemetery made by Order in Council dated the 18th day of September 1933* is hereby revoked.
(2) The said Order in Council is hereby accordingly amended by omitting from the second column of the Schedule the words “Hampden Bush” where they appear opposite the reference to the Waipawa County Council in the first column of the Schedule.

SCHEDULE
ALL that area in the Hawke’s Bay Land District containing 1 acre, more or less, being Lot 1 of Agricultural Section 37, Tikokino, Block XIII, Maraekakaho Survey District; as shown on plan marked 191/2/241 held in the office of the Department of Health, Wellington, and thereon edged red (S.O. Plan 1005).

PURSUANT to the Cemeteries Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER
-
(1) This order may be cited as the Takapau Cemetery Order 1964.
(2) This order shall come into force on the 1st day of May 1964. -
The Waipawa County Council is hereby appointed to be the trustee of the Takapau Cemetery, being the area described in the Schedule hereto, and shall have the control and management of that cemetery under and for the purposes of the Cemeteries Act 1908.

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the assignment to Thomas Martin Devitt and Elizabeth Dudley Devitt, of Ruakaka Bay, Queen Charlotte Sound, by Robert Berryman, of Wellington, of his rights, powers, and privileges under an Order in Council dated the 7th day of November 1946 and published in the Gazette on the 14th day of the same month at page 1734.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises, subject to the conditions hereinafter set forth, H. F. Stevens Ltd., a company duly incorporated under the Companies Act 1933 and having its registered office at Christchurch, (hereinafter referred to as the licensee), to lay, construct, put up, place, and use the electric lines described in the Schedule hereto.

CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1961 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
- The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
SYSTEM OF SUPPLY
- The system of supply shall be as described in paragraph (a) of regulation 21–01 of the Electrical Supply Regulations 1935.
DURATION OF LICENCE
- Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1971.
LIMITATION AS TO USE OF ELECTRIC LINES
- The electric lines described in the Schedule hereto shall be used by the licensee only during periods when the supply of electrical energy from the Christchurch City Council is insufficient or is not available.

SCHEDULE
CABLE for the supply of electrical energy by the system of supply hereinbefore described, commencing from the generating room in the Christchurch Press Co. Ltd.’s building, Cathedral Square, in the City of Christchurch, and proceeding in a south-easterly direction generally through the said building, thence through the licensee’s building, along a light-well and a right of way to the main switchboard situated on the ground floor of the licensee’s building.
The said cable being more particularly shown by means of a red line on the plan marked S.H.D. 275 deposited in the office of the New Zealand Electricity Department at Wellington.
