Declaring an Easement Over Land Taken for the Purposes of
a Public School in Block XII, Waitemata Survey District

Pursuant to section 32 of the Public Works Act 1928, the
Minister of Works hereby declares that, a sufficient agreement
to that effect having been entered into, a batter easement is hereby taken for the purposes of a public school
over the land described in the First Schedule hereto vesting
in Her Majesty the Queen the right to deposit soil on the
said land for the purpose of forming and constructing the
batters of an accessway over adjoining land, with a right for
Her Majesty the Queen and her tenants, agents, servants,
workmen, invitees, and licensees from time to time and at
all times to enter upon the said land with or without vehicles
and implements of any kind for the purpose of maintaining
and repairing the said batter easement, such easement to be
held appurtenant to the land described in the Second Schedule
hereto from and after the 16th day of March 1964.

FIRST SCHEDULE

North Auckland Land District

All that piece of land containing 7.5 perches situated in Block
XII, Waitemata Survey District, North Auckland R.D., and
being part Lot 1, D.P. 51073; as the same is more particularly
delineated on the plan marked M.O.W. 18249 (S.O. 44281)
deposited in the office of the Minister of Works at Wellington,
and thereon coloured yellow.

SECOND SCHEDULE

North Auckland Land District

All that piece of land containing 2 roods 23 perches situated
in Block XIII, Waitemata Survey District, Borough of Birkenhead, North Auckland R.D., and being Lots 81 and 102, D.P.
51624, and being the whole of the land in Proclamation No.
20039, North Auckland Land Registry.
