Declaring Land Together With a Right of Way Held for a Government Work and Not Required for That Purpose to be Crown Land

PURSUANT to section 35 of the Public Works Act 1928, the Minister of Works hereby declares the land described in the Schedule hereto, together with the right of way created by memorandum of transfer No. 141463, Otago Land Registry, to be Crown land subject to the Land Act 1948 as from the 16th day of March 1964.

Assent to Agreement for Grant of Easement in Favour of Dalgety's Properties (N.Z.) Ltd., a Duly Incorporated Company, Having its Registered Office at Wellington, Over Land in Block XI, Matakohe Survey District, Taken For a Public School

WHEREAS by declaration dated the 31st day of October 1963, published in the Gazette, 7 November 1963 at page 1808, an area of land containing 1·5 perches situated in Block XI, Matakohe Survey District, North Auckland R.D., and being part Lot 2, D.P. 34979 was taken for a public school;

And whereas at the date such declaration took effect Dalgety's Properties (N.Z.) Ltd., a duly incorporated company, having its registered office at Wellington, was entitled to compensation in respect of its interest in the said land;

And whereas the Minister of Works and the said Dalgety's Properties (N.Z.) Ltd. have agreed that the said company shall have the right to retain on part of the said land above described two concrete buttresses being part of the building owned by the said Dalgety's Properties (N.Z.) Ltd.;

And whereas the Minister of Works has agreed to grant, and the said Dalgety's Properties (N.Z.) Ltd. has agreed to accept, in part satisfaction of the compensation aforesaid, the right to retain on part of the said land two concrete buttresses as aforesaid, together with the right to enter upon the said land with or without engineers and workmen and with or without any necessary implements tools and equipment of any kind for the purpose of inspecting, repairing or maintaining the said concrete buttresses from time to time as shall be necessary thereto;

Now, therefore, the Minister of Works doth hereby give notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.

Declaring Area to be an Access Lane for the Purposes of the Motor Launch Regulations 1962

PURSUANT to the Motor Launch Regulations 1962, the Minister of Marine hereby declares that, for a period of two years from the date hereof, subject to compliance with the conditions set out in the First Schedule hereto, the area of water described in the Second Schedule hereto shall be an access lane and that within such access lane regulations 11 and 12 of the Motor Launch Regulations 1962 shall not apply.

FIRST SCHEDULE

THE access lane shall be marked as follows:

  1. Brightly painted marker buoys each 50 yards apart commencing 50 yards from high-water mark shall be suitably moored along each side of the access lane.

  2. At high-water mark on the foreshore at each side of the access lane in line with the marker buoys there shall be placed a notice board measuring not less than 2 ft 6 in. by 2 ft, painted white with black letters.

  3. The aforesaid notice boards shall contain the following notice:

NOTICE

Motor Launch Regulations 1962

Access lane through which motor launches and water skiers may pass at speeds greater than 5 miles per hour.

BATHERS KEEP OUT"

SECOND SCHEDULE

ALL that area of water at Kelly's Beach in the Hauraki Gulf bounded on the sides by parallel lines 100 yards apart extending in a 330° true direction 200 yards from the edge of the water, the eastern boundary commencing 1 chain west of the legal boundary between Allotment 43, Maraetai Parish, and Allotment 78, Maraetai Parish.

PURSUANT to the provisions of the Standards Act 1941 and regulations made thereunder, the Minister of Industries and Commerce, on 25 February 1964, revoked the standard specifications listed in the Schedule hereto.
