PURSUANT to the Cemeteries Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

This order may be cited as the Morven Catholic Burial Ground Closing Order 1964.

It is hereby directed that the Morven Catholic Burial Ground, being the area described in the Schedule hereto, shall be closed and burials therein discontinued after the 30th day of September 1964.

It is hereby declared that the Morven Catholic Burial Ground shall vest, on the 1st day of October 1964, in the Waimate County Council as a closed burial ground for maintenance in good order as a public reserve.
SCHEDULE
ALL that area in the Canterbury Land District containing 2 acres and 3 perches, more or less, being part Rural Section 24671 and part Subdivision 4 of Reserve 631, situated in Block XI, Waitaki Survey District, and being all the land comprised and described in certificate of title, Volume 206, folio 248, Canterbury Registry; as shown on plan marked 191/4/45, held in the office of the Department of Health at Wellington, and thereon edged red (Plan T. 59297M).

PURSUANT to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the access way described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Citizens of the Borough of Devonport and be under the control and management of the Devonport Borough Council.

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Wellington City Council on the 18th day of March 1963 and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto.
FIRST SCHEDULE
THE Wellington City Council, being the local authority having control of streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the western side of the portion of Maginnity Street adjoining part Lot 1, D.P. 10807, being all (or part) of the land in certificate of title, Volume 353, folio 276, limited, Wellington Registry, as is more particularly shown on the plan annexed hereto.
SECOND SCHEDULE
WELLINGTON LAND DISTRICT
THE western side of all that portion of street situated in the City of Wellington, known as Maginnity Street, fronting part Lot 1, D.P. 10807, being Sections 165 and 166 and part Section 167, Provincial Government Reclamation.
As the same is more particularly delineated on the plan marked M.O.W. 18185 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
