Declaring Land in South Auckland Land District, Vested in the South Auckland Education Board as a Site for a Public School, to be Vested in Her Majesty the Queen

A PROCLAMATION

PURSUANT to subsection (6) of section 5 of the Education Lands Act 1949, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto, being part of an area vested in the South Auckland Education Board as a site for a public school, shall be vested in Her Majesty the Queen, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date hereof.

SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

Lots 3, 4, 5, 6, 11, 12, 13, and 14, D.P. 284, being parts Loan and Mercantile Grant: Area, 2 acres, more or less. All certificate of title, Volume 67, folio 8.

And Allotment 273, Komakorau Parish: Area, 1 rood 23'5 perches, more or less. All certificate of title, Volume 626, folio 232. (S.O. Plan 25234.)

Crown Land Set Apart as Permanent State Forest Land

A PROCLAMATION

PURSUANT to section 18 of the Forests Act 1949, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby set apart the Crown land described in the Schedule hereto as permanent State forest land.

SCHEDULE

NELSON LAND DISTRICT-NELSON CONSERVANCY

ALL those areas in Kaiteriteri Survey District, Waimea County, containing approximately 3,290 acres 3 roods 20 perches, being Sections 5, 6, 7, 8, 9, and 10, Block V: Area, 1,796 acres, more or less. (S.O. Plan 6015.) Also Section 2, Block X; Sections 1, 86, and 101, Block XII; Sections 1A, 4, 5, 6, 7, part Section 8, and Lot 11, D.P. 4161, being Section 204, Block VIII: Area, 1,494 acres 3 roods 20 perches, more or less. As shown on plan numbered 99/16 deposited in the Head Office of the New Zealand Forest Service at Wellington, and thereon bordered red.

Declaring Certain Restrictions as to the Use of Boats in a Wildlife Refuge in the Hawke's Bay Acclimatisation District

A PROCLAMATION

PURSUANT to section 14 of the Wildlife Act 1953, I Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand hereby revoke the proclamation published in the New Zealand Gazette, 4 April 1957, No. 27, page 575, as to the use of boats in those areas in the Hawke's Bay Acclimatisation District proclaimed a wildlife refuge for the purposes of the Wildlife Act 1953 and published in the Gazette, 14 March 1957, No. 22, page 470, in so far as the said proclamation relates to Lake Tutira, and hereby proclaim and declare that the restrictions set forth in the Schedule hereto shall henceforth apply in the aforesaid Lake Tutira.

SCHEDULE

THE use of boats in Lake Tutira is hereby restricted to boats wholly propelled by oars, sails, or paddles except that the Secretary for Internal Affairs may, for the purposes of scientific or piscicultural investigations, authorise the use of boats propelled by any other means.

Revoking a Wildlife Refuge and Declaring Land in the North Auckland Land District to be a Wildlife Sanctuary

A PROCLAMATION

PURSUANT to the Wildlife Act 1953, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby revoke the Warrant published in the Gazette of 18 May 1933 notifying and declaring an area of land to be a wildlife refuge and hereby proclaim and declare the area of land described in the Schedule hereto to be a wildlife sanctuary for the purpose of the said Wildlife Act, and the following conditions shall apply to the sanctuary:

  1. The right of entry to the sanctuary is hereby restricted to the following classes of persons:

(a) The Maori owners whose names are recorded as such in the records of the Maori Land Court.

(b) Members of the Tawatawa and Whiritoa tribes for the purpose of exercising their rights under any permits issued for the taking of the young of the grey-faced petrel (Pterodroma macroptera) issued under section 6 of the Wildlife Act 1953.

(c) Rangers under the Wildlife Act 1953 while in the lawful execution of their duty.

(d) Any other person authorised in writing by the Secretary for Internal Affairs.

  1. The hunting or killing, taking for any purposes, molesting, capturing, disturbing, harrying or worrying of any living creature in the sanctuary, the taking, destruction, or disturbance of the eggs or spawn of any such creature, the taking for any purpose, or interference with vegetation of any description in the sanctuary, the introduction or liberation in the sanctuary of any living creature or the eggs or spawn of any living creature, or the introduction or planting in the sanctuary of any vegetation of any description or the spores of seeds of any vegetation of any description is hereby prohibited except pursuant to an authority issued by the Secretary for Internal Affairs for that purpose: Provided that members of the Tawatawa and Whiritoa tribes shall be permitted to take the young of the grey-faced petrel (Pterodroma macrop- tera) subject to such conditions as the Minister of Internal Affairs may impose in any notification issued under section 6 of the Wildlife Act 1953.

  2. The burning or clearing by any means whatsoever of any trees, shrubs, grasses, or other plant life on the sanctuary is hereby prohibited except pursuant to an authority issued by the Secretary for Internal Affairs for that purpose.

  3. Camping in the sanctuary is hereby prohibited except pursuant to an authority issued by the Secretary for Internal Affairs for that purpose.

  4. The lighting of fires or the doing of anything likely to cause a fire on the sanctuary is hereby prohibited except pursuant to an authority issued by the Secretary for Internal Affairs for that purpose.

  5. The taking of firearms or explosives on or onto the sanctuary or the use of firearms or explosives in the sanctuary, is hereby prohibited except pursuant to an authority issued by the Secretary for Internal Affairs for that purpose.

  6. The taking or keeping of domestic animals or domestic birds into or in the sanctuary is hereby prohibited except pursuant to an authority issued by the Secretary for Internal Affairs for that purpose.

  7. The depositing of rubbish or the leaving of litter in the sanctuary is hereby prohibited.

SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL that group of islands and reefs situated in the North Auckland Land District and in the Bay of Plenty, known as the Aldermen Islands: Area, 330 acres, more or less. As delineated on the plan marked 52/5 deposited in the Head Office, Department of Internal Affairs, Wellington, and thereon coloured red. (S.O. Plan 34773.)
