Declaring Portion of a Road in the Whangarei County to be
a County Road

ORDER IN COUNCIL

At the Government House at Wellington this 23rd day of October 1963

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL that portion of road in Whangarei County situated in Block VIII, Ruakaka Survey District, commencing at the junction of Peter Snell and Papich Roads, at the northernmost corner of Section 4 of the aforesaid Block VIII, and proceeding thence in a southerly direction generally for a distance of approximately 45 chains; as the same is more particularly delineated on the plan marked M.O.W. 8717 (S.O. 43861) deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B.

Varying a Condition as to Setting Back the Building Line
of Part of a Street off Kauri Glen Road in the Borough
of Birkenhead, Imposed by an Order in Council under
Section 31 of the Municipal Corporations Amendment Act
1948 and Section 125 of the Public Works Act 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 6 of the Public Works Amendment Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council, registered in the North Auckland Land Registry Office at Auckland under No. 13811, subject to a condition as to the building line, by varying the condition as to the building line imposed by the said Order in Council so that no building or part of a building shall at any time be erected on Lot 42, D.P. 41159, within a distance of 6 ft from the side line of the said street.

The Tahuna Cemetery Order 1963

ORDER IN COUNCIL

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Cemeteries Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. (1) This order may be cited as the Tahuna Cemetery Order 1963.
    (2) This order shall come into force on the 1st day of November 1963.

  2. The Waitomo County Council is hereby appointed to be the trustee of the Tahuna Cemetery, being the area described in the Schedule hereto, and shall have the control and management of that cemetery under and for the purposes of the Cemeteries Act 1908.

  3. (1) The delegation to the Waitomo County Council of the powers of appointing and removing trustees of the said cemetery made by Order in Council dated the 27th day of April 1934* is hereby revoked.
    (2) The said Order in Council is hereby accordingly amended by omitting from the Schedule the words “Waitomo County Council . . . Tahuna”.

SCHEDULE

ALL that area in the Taranaki Land District, containing 5 acres and 18 perches, more or less, being Section 27, Block XI, Mapara Survey District; as shown on plan marked 191/2/24, held in the office of the Department of Health, Wellington, and thereon edged red, which plan is a copy of Survey Office Plan 4024.

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council and with the consent of the licensee, hereby revokes the Order in Council, dated the 25th day of September 1957 and published in the Gazette on the 26th day of the same month at page 1711, authorising Kenneth Farrell, of Owen River Valley, farmer, to use water for the purpose of generating electricity and to erect and use certain electric lines.
