This order may be cited as the Hawea Flat Irrigation District Order 1963.

The Minister of Works is hereby authorised to construct, maintain, and control the water supply works described in the First Schedule hereto to serve the district described in the Second Schedule hereto.

The area of land described in the Second Schedule hereto is hereby constituted as an irrigation district to be known as the Hawea Flat Irrigation District (herein referred to as the district).

It is hereby declared that the water quotas for the land in the district not exempted, pursuant to section 13 of the Public Works Amendment Act 1960, shall be 20in. over the land commanded by supply points receiving water from the main gravity races and 17in. over the land commanded by supply points receiving water from the main pumping race.

It is hereby declared that the irrigation charge which will be payable for half of the respective water quotas shall be thirty shillings (30s.) per acre of land in the district commanded by supply points and not exempted as aforesaid, reducible over the first nine irrigation seasons of supply to the charges set out in the Third Schedule hereto.

It is hereby declared that the respective charges which will be payable for such water as may be supplied in excess of half the proposed water quotas, but not in excess of the total proposed water quotas shall be at the rate of eighteen shillings (18s.) per acre-foot for water received from supply points from the main gravity races and twenty-one shillings (21s.) per acre-foot for water received from supply points from the main pumping race.
FIRST SCHEDULE
WATER SUPPLY WORKS
THE Hawea Flat Irrigation Works (for the irrigation of the district) by means of water drawn from Lake Hawea and from any dam or dams which are or may be constructed or required on the said lake, such water being conveyed into the district by a race or races constructed or acquired by the Minister of Works or by any enlargement or extension thereof; the said works including all dams, weirs, reservoirs, tunnels, fluming, siphons, piping, gauge boxes, and races and all other works incidental to or required for the construction, maintenance, and control of the said works for the irrigation of the district.
SECOND SCHEDULE
HAWEA FLAT IRRIGATION DISTRICT
ALL that area in the Otago Land District, Vincent County, containing 9,900 acres, more or less, bounded by a line commencing at the northernmost corner of Section 12, Block V, Lower Hawea Survey District, and proceeding southerly and westerly along the eastern and southern boundaries of that section to the easternmost corner of Section 82, Block V aforesaid; thence south-westerly along the north-western boundaries of Section 86, Block V aforesaid, to the north-eastern side of Luggate-Hawea road; thence generally south-easterly along that side of that road to the southernmost corner of Section 85, Block V aforesaid; thence due east to the western side of Luggate-Hawea road aforesaid; thence south-easterly along the south-western side of that road to the south-eastern corner of Section 15, Block V aforesaid; thence due west and due north along the southern and western boundaries of that section to the north-eastern corner of Section 21, Block V aforesaid; thence due west along the northern boundary of that section and its production to the north-western corner of Section 21 aforesaid; thence due south and due west along the eastern and southern boundaries of Section 22, Block V aforesaid, and the southern boundaries of Sections 23 and 24, Block V aforesaid, to the south-western corner of the last-mentioned section; thence northerly along the western boundary of Section 24 aforesaid to a point in line with the northern boundary of Section 15, Block VI, Lower Hawea Survey District; thence due west to and along that boundary to the eastern boundary of Section 7, Block VI aforesaid; thence due south and due west along the eastern and southern boundaries of that section to the western boundary of Section 8, Block VI aforesaid; thence due south and due west along the eastern and southern boundaries of Section 8, Block VI aforesaid, to the south-eastern corner of Section 1, Block XI, Lower Wanaka Survey District; thence due west, north-westerly, and south-westerly along the southern, south-western, and south-eastern boundaries of that section to a point in line with the western boundary of Section 4, Block XI aforesaid; thence due south to and along that boundary and its production to the left (north-eastern) bank of the Clutha River; thence generally north-westerly along that bank and generally north-easterly along the left (generally south-eastern) bank of the Hawea River to a point in line with the western boundary of Section 4, Block V, Lower Wanaka Survey District; thence due north to and along that boundary and its production to the westernmost corner of Section 2, Block V aforesaid; thence north-easterly and due south along the north-western and eastern boundaries of that section and the production of the last-mentioned boundary to the south-eastern side of No. 6 State Highway; thence north-easterly along the south-eastern side of that State highway to the northern boundary of Section 11, Block III, Lower Hawea Survey District; thence westerly along the northern boundary of that section and its production to the middle of the Hawea River; thence generally northerly up the middle of that river to a point in line with the south-western boundary of a road intersecting Section 28, Block IV, Lower Hawea Survey District; thence generally south-easterly to and along the generally south-western sides of that road intersecting that Section 28 and Section 1, Block IV aforesaid, and forming the generally eastern boundaries of Sections 1, 27, 36, and again 27, Block IV aforesaid, to a point in line with the southern side of Cemetery Road; thence due east to and along that side of that road to the north-eastern corner of Section 8, Block IV aforesaid; thence southerly along the eastern side of Section 8 aforesaid and Section 13, Block IV aforesaid, to the southern boundary of Section 10, Block I, Lower Hawea District; thence due east along that boundary and due south along the eastern boundary of Section 10 aforesaid to the north-eastern corner of Lot 1, D.P. 7777; thence due west, due south, and due east along the northern, western, and southern boundaries of that lot to the western side of Hawea-Gladstone road; thence due south along that side of that road to a point in line with the northern boundary of Section 22, Block I aforesaid; thence due east to and along that boundary and due south along the eastern boundary of Section 22 aforesaid and its production to the south-eastern corner of Section 19, Block I aforesaid; thence due west along the southern boundary of that section to the north-western corner of Section 1, Block V, Lower Hawea Survey District; thence due south and due east along the western and southern boundaries of that section and the production of the last-mentioned boundary to the north-western boundary of Section 12, Block V aforesaid; thence north-easterly along that boundary of that section to the point of commencement. As the same is more particularly shown coloured blue on a plan marked M.O.W. 8190 deposited in the office of the Minister of Works at Wellington.
THIRD SCHEDULE
REDUCED IRRIGATION CHARGES
Season of Supply Charge
First season ....... Three shillings per acre.
Second season ...... Six shillings per acre.
Third season ....... Nine shillings per acre.
Fourth season ...... Twelve shillings per acre.
Fifth season ....... Fifteen shillings per acre.
Sixth season ....... Eighteen shillings per acre.
Seventh season ..... Twenty-one shillings per acre.
Eighth season ...... Twenty-four shillings per acre.
Ninth season ....... Twenty-seven shillings per acre.

Authorising Lloyd James Veint, Farmer, of Diamond Lake, Otago, to Use Water for the Purpose of Generating Electricity and to Erect and Use Certain Electric Lines

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Lloyd James Veint, Diamond Lake, Otago, farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from Swamp Creek (hereinafter referred to as the said stream), situated in State Forest Block 29, Block 2, Dart Survey District, for the purpose hereinafter set forth, a stream of water not exceeding one and a half cubic feet per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.
CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
- This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
