Consenting to Stopping Road in Blocks XII and XVI, Alford Survey District, Ashburton County

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Ashburton County Council stopping the portions of road described in the Schedule hereto.

Declaring Road to be Government Road in Blocks X and XIV, Waitemata Survey District

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

Authorising the Laying Off of an Extension of Warwick Street in the City of Dunedin, Subject to a Condition as to the Building Line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Dunedin City Council to permit the laying off of the proposed new street described in the Schedule hereto at a width of less than 66ft, but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked M.O.W. 5857 referred to in the said Schedule within a distance of 15 ft from the side lines of the said new street.

Appointing a Commission to Inquire Into Improved Access by Land to the Port of Tauranga and the Bay of Plenty

ORDER IN COUNCIL

To all unto whom these presents shall come, and to:

EDGAR RAVENSWOOD McKILLOP, Esquire, C.M.G., O.B.E., M.INST., C.E., M.N.Z.I.E., of Wellington, Civil Engineer; EDWARD ALAN MILLWARD, Esquire, O.B.E., of Wanganui, Company Manager; and ROBERT WILLIAM STANNARD, Esquire, B.COM., of Wellington, Public Accountant.

GREETING:

WHEREAS it is desirable that consideration be given to the question of improved access by land to the Port of Tauranga and the Bay of Plenty and the relative merits of access by road and by rail or by a combination of both rail and road:

And whereas legislation may be desirable to make special provision in respect of the several foregoing matters or any of them:

Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, Charles John, Viscount Cobham, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council hereby appoint you, the said Edgar Ravenswood McKillop, Edward Alan Millward, and Robert William Stannard to be a Commission to inquire into and report on the following matters:

(1) Whether development of the Port of Tauranga and of industries in the Bay of Plenty or in any area served or likely to be served by the Port of Tauranga are such as to require major changes or major improvements to existing means of access by land to such port and the Bay of Plenty:

(2) Whether any changes should be by construction of new railways, by construction of new roads, by combinations of new railways and roads, or by modification of existing rail or road facilities:

(3) The particular works which should be recommended and the importance and priority of these in relation to the whole and to one another:

(4) The timing of any works recommended, having regard to the transportation load they will require to bear, their financing, and the capacity of the port which they will serve:

(5) Any legislation required to give effect to any recommendations made by you as a result of the inquiry.

And with the like advice and consent I do further appoint you, the said Edgar Ravenswood McKillop, to be Chairman of the said Commission:

And for the better enabling you to carry these presents into effect you are hereby authorised and empowered to make and conduct any inquiry under these presents at such times and places as you deem expedient, with power to adjourn from time to time and place to place as you think fit, and so that these presents shall continue in force, and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or from place to place:

And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, save to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you or any evidence or information obtained by you in the exercise of the powers hereby conferred upon you except such evidence or information as is received in the course of a sitting open to the public:

And it is hereby declared that the powers hereby conferred shall be exercisable notwithstanding the absence at any time of any one of the members hereby appointed:

And it is hereby further declared that you have liberty to report your proceedings and recommendations under this Commission from time to time if you shall judge it expedient so to do:

And using all due diligence, you are required to report to me in writing under your hands not later than the 30th day of November 1962, your findings and opinions on the matters aforesaid, together with such recommendations as you think fit to make in respect thereof.
