ORDER

  1. This order may be cited as the Land and Income Tax Payment Order 1962.

  2. Expressions used in this order have the same meanings as in the Land and Income Tax Act 1954.

  3. This order applies to:

(a) Land tax for the year of assessment which commenced on the 1st day of April 1962; and

(b) Income tax payable for that year of assessment on income derived (or deemed to have been derived) during the income year which commenced on the 1st day of April byβ€”

(i) Every subsisting company otherwise than as trustee or agent:

(ii) Every public authority otherwise than as trustee or agent:

(iii) Every Maori authority.

  1. Land tax shall be due and payable in one sum on the 7th day of October 1962.

  2. Income tax to which this order applies shall be due and payable in one sum on the 7th day of February 1963.

  3. Land tax and income tax to which this order applies shall be payable at any office of the Taxes Division, Inland Revenue Department, or at any money-order post office.

Authorising Geoff Eames Ltd., of Lake Ohau Lodge, to Use Water for the Purpose of Generating Electricity, and to Erect and Use Certain Electric Lines, and Revoking a Previous Licence

ORDER IN COUNCIL

At the Government House at Wellington this 30th day of May 1962

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Geoff Eames Ltd., a duly incorporated company having its registered office at Lake Ohau (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from an unnamed stream (hereinafter referred to as the said stream), situated in Run 530, Block II, Campbell Survey District, in the Waitaki County, for the purpose hereinafter set forth, a stream of water not exceeding 3 cubic feet per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described; and further, hereby revokes the Order in Council dated the 30th day of September 1953 and published in the Gazette on the 8th day of October 1953 at page 1620, authorising the Mount Cook and Southern Lakes Tourist Co. Ltd. to use water for the purpose of generating electricity and to erect and use certain electric lines.


CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1961 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and with all regulations hereafter made in amendment thereof or in substitution therefor respectively.

UTILISATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said stream at the point in Run 530, Block II, Campbell Survey District, as indicated on the plan marked N.Z.E.D. 583 deposited in the office of the New Zealand Electricity Department at Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being more particularly shown on the said plan N.Z.E.D. 583.

(a) Headworks consisting of a dam and intake with a pipeline leading to the powerhouse, hereinafter referred to, giving a static head of approximately 260 ft.

(b) A Pelton wheel and powerhouse with all necessary equipment for generating electricity, situated in Run 530, Block II, Campbell Survey District.

(c) A tail-race leading from the said powerhouse to another unnamed stream.

(d) Electric lines leading from the said powerhouse in an easterly direction to the Lake Ohau Lodge situated in Run 530 aforesaid.

SYSTEM OF SUPPLY

  1. The system of supply shall be as described in paragraphs (a) and (d) of regulation 21-01 of the Electrical Supply Regulations 1935, and shall be an alternating-current system.

DURATION OF LICENCE

  1. Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1983.

RENTAL

  1. For the purpose of assessing the rental or annual sum payable in respect of this licence the maximum generating capacity of the plant at the commencement of this licence is 36 kW.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the licensee any right to water.

Authorising the Auckland City Council to Erect and Use Certain Electric Lines on Motuihi Island, Hauraki Gulf

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Auckland City Council (hereinafter referred to as the licensee), subject to the conditions hereinafter set forth, to lay, construct, put up, place, and use the electric lines described in the Schedule hereto.

SCHEDULE

LINES for the supply of electrical energy by the system of supply hereinbefore described commencing from a power pole at the south-east corner of H.M.N.Z.S. Tamaki playing area, and proceeding generally in a southerly direction to a canteen and living accommodation situated in the public domain.

All being situated on Motuihi Island, Hauraki Gulf, and being more particularly shown on the plan marked N.Z.E.D. 584 deposited in the office of the New Zealand Electricity Department at Wellington.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.
