THE NEW ZEALAND GAZETTE

Schedule hereto is required to be taken; and notice is hereby
further given that a plan of the land so required to be
taken is deposited in the public offices of the Council situate
at Cambridge Street, Richmond, and is open for inspection,
without fee, by all persons during ordinary office hours. All
persons affected by the execution of the said public work or
by the taking of such land who have any well-grounded
objections to the execution of the said public work or the
taking of the said land must state their objections in writing
and send the same, within 40 days from the first publication
of this notice, to the Town Clerk at his office in Cambridge
Street, Richmond.

HAWKE'S BAY ELECTRIC POWER BOARD

NOTICE OF INTENTION TO TAKE LAND

NOTICE is hereby given that the Hawke's Bay Electric Power
Board proposes to execute a certain public work, namely, the
construction of electric works, and for the purpose of such
public work the land described in the Schedule hereto is
required to be taken; and notice is hereby further given that
a plan of the land so required to be taken is deposited at
the residence of Mr W. A. O'Brien at the southern end of
the Redclyffe Bridge across the Tutaekuri River, and is open
for inspection, without fee, by all persons during ordinary
office hours.

All persons affected by the execution of the said public
work or by the taking of the said land who have any well-
grounded objections to the execution of the said public work
or to the taking of the said land must set out their objections
in writing and send the same, within 40 days from the first
publication of this notice, to the General Manager of the
Board at the public office of the Board in Heretaunga Street,
Hastings.

36-4 perches, being part of the Waiohiki 1A 3 Block, situate
in Block VII of the Heretaunga Survey District; as the same
is more particularly delineated on the plan marked 3470
deposited in the office of the Chief Surveyor at Napier, and

Departure from Operative District Scheme

PUBLIC notice is hereby given, pursuant to the provisions of
the Town and Country Planning Act 1953 and its amendments
and of the regulations made thereunder, that the Town and
Country Planning Appeal Board, by order dated the 20th
day of March 1962, gave consent to a specific departure from
the operative district scheme of the City of Nelson to the
extent indicated hereunder:

By changing the zoning from Industrial B to Residential
A of the land described in the Schedule hereto.

Departure from Operative District Scheme

PUBLIC notice is hereby given, pursuant to the provisions of
the Town and Country Planning Act 1953 and its amend-
ments and of the regulations made thereunder, that the Town
and Country Planning Appeal Board, by order dated the 20th
day of March 1962, gave consent to a specific departure
from the operative district scheme of the City of Nelson to
the extent indicated hereunder:

By changing the zoning of the land described in the
Schedule hereto from Residential A to Industrial B subject
to the condition that a restrictive covenant is registered against
the title to the said land prohibiting any building being erected
within fifteen (15) feet of the northern boundary thereof.

1 rood 4-3 perches, being Lot 9, Deposited Plan 4057, being

MOUNT EDEN BOROUGH COUNCIL

TOWN AND COUNTRY PLANNING ACT 1953

Specific Departure from the Provisions of the Borough of
Mount Eden District Scheme

PURSUANT to the Town and Country Planning Regulations
1960, public notice is hereby given that the Town and
Country Planning Appeal Board's consent to a specific
departure from the provisions of the operative Mount Eden
Borough District Scheme, by rezoning part of the property
situated at the corner of Dominion Road and Herbert Road
from "General Residential District" to "Local Commercial
District" so as to provide a local commercial zone having a
frontage on Dominion Road 113 ft 3 in south from Herbert
Road and for a depth of 120 ft east from Dominion Road,
was approved by Council by resolution at its meeting held
on the 26th day of March 1962, after the scheme had been
amended to give effect to the specific departure as consented
to by the Board.

The Council has also resolved that the specific departure
as amended in the district scheme shall come into operation
on the 2nd day of April 1962.

The scheme with amendment as approved has been deposited
in the Council's Office and may be inspected, without fee,
by any person who so requires at any time when the office
is open to the public.

THE CHARITABLE TRUSTS ACT 1957

IN the matter of the property known as the Orange Hall,
London Street, Eltham, being part of Section 62, Eltham
Township. In 1889 the property was vested in four persons
as a site for a building to be used for religious purposes.
Notice is hereby given that the present trustees of the property
have filed an application in the Supreme Court of New
Zealand at New Plymouth, the object of which is to seek
the Court's direction as to dealing with the trust property.
In the circumstances which now exist the trustees have pre-
pared a scheme in which it is proposed that the property be
sold and the net proceeds of sale be distributed pro rata as
to number of members among such Christian religious denom-
inations as hold services in Eltham and as apply to participate
therein. Any person who desires to oppose the scheme is
hereby required to give written notice of his or her intention
to do so to the Registrar of the Court, the trustees, care of
L. A. Taylor, Esq., Hawera, and the Attorney-General of
New Zealand, care of Crown Law Office, Wellington, not
less than seven clear days before the 8th day of May 1962,
on which day the application to the Court will be heard.

matter of certain charitable trusts declared by the will
of James Henry, formerly of Invercargill, in New Zealand,
but late of Lidcombe, Sydney, New South Wales, Aus-
tralia, Retired Presbyterian Minister, deceased.

PURSUANT to the provisions of section 54 of the Charitable
Trusts Act 1957, I hereby give notice that on Monday, the
26th day of March 1962, the Supreme Court at Wellington
approved the scheme prepared by the Public Trustee and the
University of Otago and dated the 27th day of October 1961,
as reported upon by the Attorney-General in his report dated
the 14th day of December 1961, concerning the matter of
certain charitable trusts declared by the will and codicil of
James Henry, formerly of Invercargill, but late of Lidcombe,
Sydney, New South Wales, Australia, Retired Presbyterian
Minister, deceased.
