HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 274 of the Public Works Act 1928 and Part I of the Public Works Amendment Act 1960, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
- This order may be cited as the Upper Waitaki Irrigation District Order 1961.
- The Minister of Works is hereby authorised to construct, maintain, and control the water supply works described in the First Schedule hereto to serve the District described in the Second Schedule hereto.
- The area of land described in the said Second Schedule is hereby constituted as an irrigation district, to be known as the Upper Waitaki Irrigation District (herein referred to as the District).
- It is hereby declared that the water quota shall be 22 in. over the land in the District commanded by supply points and not exempted pursuant to section 13 of the Public Works Amendment Act 1960.
- It is hereby declared that the irrigation charge which will be payable for half the water quota shall be 29s. per acre of land in the District commanded by supply points and not exempted as aforesaid, reducible over the first nine irrigation seasons of supply to the charges set out in the Third Schedule hereto.
- It is hereby declared that the charge which will be payable for such water as may be supplied in excess of half the water quota but not in excess of the total water quota shall be at the rate of 16s. per acre-foot.
FIRST SCHEDULE
WATER SUPPLY WORKS
THE Upper Waitaki Irrigation Works (for the irrigation of the District) by means of water drawn from Lake Waitaki and the Awakino River and from any dam or dams which are or may be constructed or acquired on the said lake or river or any other river or stream, such water being conveyed into the District by a race or races constructed or acquired by the Minister of Works, or by any enlargement or extension thereof; the said works, including all dams, weirs, reservoirs, tunnels, fluming, siphons, piping, gauge boxes, and races, and all other works incidental to or required for the construction, maintenance, and control of the said works for the irrigation of the District.
SECOND SCHEDULE
UPPER WAITAKI IRRIGATION DISTRICT
ALL that area in the Otago Land District, Waitaki County, containing 9,625 acres, more or less, bounded by a line commencing at Trig. Station Black Hill at the south-western corner of Section 76A, Otekaieke Settlement, and proceeding northerly along the western boundary of that section to the southern boundary of Section 36A, Otekaieke Settlement; thence westerly along that boundary and its production to the north-western side of Eastern Road; thence generally south-westerly along the north-western side of that road to the southernmost corner of Section 37A, Otekaieke Settlement; thence north-westerly along the south-western boundary of Section 37A aforesaid to its westernmost corner; thence westerly along a right line to the southernmost corner of Section 24A, Otekaieke Settlement; thence north-westerly along the south-western boundary of that section and its production to the north-western side of Otekai-eke River Road; thence again north-westerly along the south-western boundary of Section 24A aforesaid to the south-eastern side of Doctors Creek Road; thence north-easterly along the south-eastern side of that road to a point in line with the south-western boundary of Section 9A, Otekaieke Settlement; thence generally north-westerly to and along the south-western boundaries of the said Section 9A and Sections 8A, 7A, and 6A, Otekaieke Settlement, to the northernmost corner of Section 27A, Otekaieke Settlement; thence north-westerly along a right line to the easternmost corner of Section 11, Block III, Kurow Survey District; thence north-westerly and south-westerly along the north-eastern and north-western boundaries of the said Section 11, to the southernmost corner of Section 12, Block III aforesaid; thence north-westerly along the south-western boundary of that section and its production to the southernmost corner of Section 1, Block III aforesaid; thence north-westerly along the south-western boundary of that section and the south-western boundary of Section 11, Block I, Kurow Survey District, to the westernmost corner of that last-mentioned section; thence generally north-easterly along the north-western boundary of the said Section 11 to the westernmost corner of Section 8, Block I, Kurow Survey District; thence south-easterly and north-easterly along the south-western and south-eastern boundaries of that section and the production of that last-mentioned boundary to the north-eastern side of No. 83 State Highway (Pukeuri-Omarama); thence generally north-westerly along the north-eastern side of that highway and its production to the north-eastern side of the Kurow Branch Railway; thence generally north-westerly along the north-eastern side of that railway to a point in line with the north-western boundary of Section 2A, Kurow Settlement; thence south-westerly to and along the north-western boundary of that section, the north-western boundary of Section 1A, Kurow Settlement, and the production of that last-mentioned boundary to the easternmost corner of Section 16A, Kurow Settlement; thence north-westerly along the north-eastern boundary of that section to the easternmost corner of Section 17A, Kurow Settlement; thence generally south-westerly and northerly along the south-eastern and western boundaries of the said Section 17A and the western boundary of Section 20A, Kurow Settlement, to the north-western boundary of the said Section 20A; thence north-easterly, south-easterly, and north-easterly along the north-western, north-eastern, and again north-western boundaries of that section to the easternmost corner of Section 21A, Kurow Settlement; thence north-westerly along the north-eastern boundaries of that section and Sections 24 and 18, Block X, Kurow Survey District, to the north-western boundary of that last-mentioned section; thence north-easterly along a right line being the production of that north-western boundary of Section 18 aforesaid to the south-western boundary of part Lot 1, D.P. 1084; thence north-westerly along that south-western boundary to the southernmost corner of the land shown on D.P. 4213; thence generally north-easterly, north-westerly, and westerly along the south-eastern, north-eastern, and northern boundaries of the land shown on that D.P., and the production of that last-mentioned boundary to the north-western boundary of part Lot 1, D.P. 1084; thence north-easterly along that boundary to a point in line with the southern boundary of Allotment 2A, Blocks I and IV, Kurow Survey District; thence westerly to and along that boundary and generally north-easterly along the north-western boundaries of Allotment 2A aforesaid and Allotment 1A, Blocks I and IV, Kurow Survey District, and the land shown on D.P. 1099 to the easternmost corner of Section 15, Block IV, Kurow Survey District; thence generally north-westerly along the north-eastern boundaries of the said Section 15 and Section 21, Block V, Kurow Survey District, to the south-western side of No. 83 State Highway (Pukeuri-Omarama); thence generally north-westerly along the south-western side of that highway to an old peg, bearing 282Β° 20' 40" distant 313 links from Iron Tube XIII, S.O. 12179; thence along a right line bearing 47Β° 05' to the right (south-west) bank of the Forebay of the Waitaki Hydro Electric Station; thence generally south-easterly along that bank and its production to the commencement of the right bank of the Tail Race (Waitaki River); thence generally south-easterly along the right (south-west) bank of the Waitaki River to the easternmost corner of Crown land, Block V, Maerewhenua Survey District, distant 880 links approximately, north-easterly from the northernmost corner of Section 66A, Otekai-eke Settlement; thence generally south-westerly and southerly along the south-eastern and eastern boundaries of that Crown land and the production of that last-mentioned boundary to the eastern boundary of Section 66A, Otekai-eke Settlement; thence southerly along that boundary and its production to the south-western side of No. 83 State Highway (Pukeuri-Omarama); thence south-easterly along the south-western side of that highway to the western side of Stringer Road; thence generally southerly along the western side of that road to the southern boundary of part Section 48A, Otekai-eke Settlement; thence westerly along that boundary and the southern boundary of Section 76A, Otekai-eke Settlement, to the point of commencement.
As the same is more particularly shown coloured red on the plan marked M.O.W. 2228 deposited in the office of the Minister of Works at Wellington.
