HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Municipal Corporations Act 1954, as amended
by section 2 of the Municipal Corporations Amendment Act
1956, His Excellency the Governor-General, acting by and
with the advice and consent of the Executive Council, hereby
consents to the closing of the portion of street known as
Rugby Street, in the City of Wellington, described in the
Schedule hereto.

WELLINGTON LAND DISTRICT
ALL that piece of street containing 1·39 perches situated in the
City of Wellington, Wellington R.D., adjoining land on Plan
A/1711, being part Section 677, Town of Wellington; as the
same is more particularly delineated on the plan marked
M.O.W. 3059 (S.O. 24641) deposited in the office of the
Minister of Works at Wellington, and thereon coloured green.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
PURSUANT to the Public Works Act 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, hereby makes the following order.

LICENCE
- This order may be cited as the Westland Electric Power
Board Water Power and Electric Lines Licence 1961. - Subject to the conditions hereinafter set forth, the West-
land Electric Power Board (hereinafter referred to as the
licensee) is hereby granted a licence to obstruct, impound, or
divert the waters of the Wainihinihi Creek, Kawhaka Creek,
McPherson’s Creek, and Kapitea Creek, situated in the West-
land County, to raise or lower the levels thereof, and to take
and use therefrom for the purpose hereinafter set forth streams
of water not exceeding in all 160 cu. ft. per second, and also
to lay, construct, put up, place, and use the electric lines des-
cribed in the First Schedule hereto. - The conditions directed to be implied in all licences by
the Water Power Regulations 1934 and the Electrical Supply
Regulations 1935 shall be incorporated herein and shall form
part of this licence, except in so far as they may be inconsistent
with the provisions of this licence. - This licence is issued under the Water Power Regulations
1934, and is subject thereto, and to the Electrical Supply
Regulations 1935, the Electrical Wiring Regulations 1935, the
Radio Interference Regulations 1958, and to all regulations
made in amendment thereof or in substitution therefor, except
in so far as they may be inconsistent with the provisions of
this licence. - The water shall be taken from:
(a) The Wainihinihi Creek at a point in Block X, Turiwhate
Survey District.
(b) The Kawhaka Creek at a point in Block V, Turiwhate
Survey District.
(c) McPherson’s Creek at a point in Block IX, Turiwhate
Survey District.
(d) The Kapitea Creek at a point in Block XVI, Waimea
Survey District.
(e) The Kawhaka Creek at a point in Block VIII, Kaniere
Survey District.
All as indicated on the plan marked N.Z.E.D. 565 deposited
in the office of the New Zealand Electricity Department at
Wellington. The water shall be used solely for the purpose
of generating electricity provided that nothing in this licence
shall prevent the use of the water for supply to the Borough
of Kumara or for mining purposes.
- The licensee is hereby authorised, subject to the conditions
hereof, to construct, maintain, and use the works described
in the Second Schedule hereto, the positions of the said works
being indicated on the said plan N.Z.E.D. 565 and on the plan
marked N.Z.E.D. 566 deposited as aforesaid. - The systems of supply shall be as described in para-
graphs (a), (b), (d), (e), and (f) of regulation 21–01 of the
Electrical Supply Regulations 1935. - The lines authorised in paragraph (b) of the First
Schedule shall not be used for the purpose of supply to any
consumer in the Borough of Hokitika. - Nothing in this licence shall of itself be deemed to confer
upon the licensee any right to water. - This licence shall, unless sooner lawfully determined,
continue in force until the 31st day of March 1982. - The powers conferred upon the licensee by this licence
may be delegated by deed to Westland Power Ltd. upon the
terms contained in a draft agreement between the licensee and
that company and approved by the Minister of Electricity
contemporaneously with the issue of this licence.

FIRST SCHEDULE
ELECTRIC LINES
(a) Lines for the transmission and supply of electrical energy
in the Westland Electric Power District, with the exception
of the Borough of Hokitika as at present constituted and of
the premises of the Westland Public Hospital, namely, all that
area in the Westland Land District comprising part of the
County of Westland and the Boroughs of Kumara and Ross,
bounded by a line commencing at Trig. Station H.P., Harper
Pass, on the summit of the Southern Alps, Block III, Tara-
makau Survey District, and proceeding south-westerly generally
along that summit to Whitcombe Pass; thence north-westerly
along a right line to the source of the Whitcombe River; thence
northerly generally down the right bank of that river to its
junction with Price River; thence north-westerly along a right
line to the source of the Mikonui River; thence north-westerly
generally down the right bank of that river to the sea coast;
thence north-easterly generally along the sea coast to a point
in line with the south-western side of D.J. Road; thence south-
easterly to and along the south-western side of that road to a
point in line with the southernmost corner of Reserve 1979
(State forest); thence north-easterly along a right line to that
corner of Reserve 1979; thence south-easterly generally along
the northern side of D.J. Road to the south-eastern corner
of Rural Section 3184 situated in Blocks VII and XI, Waimea
Survey District; thence north-easterly and north-westerly along
the south-eastern and north-eastern boundaries of that section
to a point in line with the south-eastern boundary of Rural
Section 3849; thence northerly generally to and along that
boundary and the south-eastern and eastern boundaries of
Rural Section 3185 to the southern boundary of Rural Section
2069; thence north-easterly and north-westerly along the south-
eastern and north-eastern boundaries of that section to the
eastern boundary of Block VII, Waimea Survey District;
thence northerly along that boundary to the middle of the
Taramakau River; thence easterly generally up the middle
of that river to the point of commencement; excluding there-
from the Borough of Hokitika as described in Gazette, 1925,
page 1923, and the premises of the Westland Public Hospital
being Reserve 144, Block XII, Waimea Survey District. As
the said area is more particularly delineated on the said plan
N.Z.E.D. 565, and thereon edged red.
(b) Lines for the transmission of electrical energy by the
systems of supply hereinbefore described within the Borough
of Hokitika as shown by means of a red line on the plan
marked S.H.D. 183 deposited in the office of the New Zealand
Electricity Department.

SECOND SCHEDULE
GENERAL DESCRIPTION OF GENERATING WORKS
(a) Headworks consisting of weirs, dams, and necessary
intakes on the Wainihinihi Creek, Kawhaka Creek, McPherson’s
Creek, and Kapitea Creek.
(b) Races, canals, penstocks, and pipelines leading from
such weirs and dams to the reservoirs or to the powerhouse
hereinafter referred to.
(c) Reservoirs in or adjacent to the Kapitea Creek.
(d) Powerhouse with water turbines, generators, and all
necessary equipment for generating electricity, having a maxi-
mum capacity of 1245 kilovolt-amperes.
(e) Tailrace from the powerhouse aforesaid to the Tara-
makau River.
