Reorganisation of Drainage Districts on Hauraki Plains

ORDER IN COUNCIL
At the Government House at Wellington this 28th day of June 1961
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall come into force on the 1st day of July 1961.
  2. The Hauraki Plains Drainage District is hereby abolished.
  3. The Netherton Drainage District is hereby abolished and the Netherton Drainage Board is hereby dissolved.
  4. (a) The area described in the First Schedule hereto is hereby excluded from the Thames Valley Drainage District.
    (b) The areas described in the Second Schedule hereto are hereby included in the Thames Valley Drainage District.
    (c) The boundaries of the Thames Valley Drainage District as so altered shall be as defined in the Third Schedule hereto.
  5. (a) The area described in the Fourth Schedule hereto is hereby excluded from the Hauraki United Drainage District.
    (b) The boundaries of the Hauraki United Drainage District as so altered shall be as defined in the Fifth Schedule hereto.
  6. (a) The area described in the Sixth Schedule hereto is hereby constituted a drainage district to be known as the Hauraki South Drainage District.
    (b) (i) The first election of trustees of the Hauraki South Drainage District shall be held on the day fixed by law for the next triennial general election of trustees of drainage districts.
    (ii) Until the coming into office of the trustees of the Hauraki South Drainage District following the said election, the Board of the said District shall consist of:
    Five trustees to be nominated by the present Netherton Drainage Board;
    One trustee representing the Awaiiti area to be nominated by the Thames Valley Drainage Board;
    One trustee representing the Kerepehi area to be nominated by the Hauraki Catchment Board;
    (iii) For the purpose of nominating five trustees to represent it on the Hauraki South Drainage Board as hereinbefore provided, but for no other purpose, the Netherton Drainage Board may continue in office after the 30th day of June 1961.
    (c) The assets and liabilities of the Netherton Drainage Board shall vest in and become the assets and liabilities of the Hauraki South Drainage Board.
  7. Except as otherwise provided herein the reorganisation of drainage districts hereby effected shall be deemed to have been effected under the Land Drainage Act 1908.

FIRST SCHEDULE
AREA EXCLUDED FROM THAMES VALLEY DRAINAGE DISTRICT
ALL that area in the South Auckland Land District in Hauraki Plains County bounded by a line commencing at the westernmost corner of Section 70, Block VI, Waihou Survey District, and proceeding south-easterly generally along the north-eastern boundary of Thames Valley Drainage District as described in Gazette, 1953, page 1553, to the north-western corner of part Awaiiti 1J 2B 2B in Block XV, Waihou Survey District; thence north-westerly along a right line across Awaiiti South Road and Awaiiti 1J 2B 1B 2B 2C 2 to the easternmost corner of Section 15, Block XV aforesaid (Awaiiti Canal); thence westerly generally along the generally eastern and southern boundaries of the said Section 15 to and northerly along the eastern side of the Elstow Canal Reserve shown on S.O. 24202 (sheet 2), to its junction with the boundary of Thames Valley Drainage District; thence along that boundary as described in Gazette, 1953, page 1553, to the point of commencement.

SECOND SCHEDULE
AREAS INCLUDED IN THAMES VALLEY DRAINAGE DISTRICT
ALL that area in the South Auckland Land District in Piako County bounded by a line commencing at the junction of the right bank of the Waitoa River with the south-western boundary of Kopuatai 3 in Block VI, Waitoa Survey District, and proceeding south-easterly along that south-western boundary and the south-western boundaries of part Kopuatai 6 to and easterly, south-westerly, and westerly generally along the boundary of Thames Valley Drainage District as described in Gazette, 1953, page 1554, to the point of commencement.
Also all that area in the South Auckland Land District in Piako County bounded by a line commencing at the northernmost corner of Section 20, Block VII, Waitoa Survey District, and proceeding northerly along a right line to the westernmost corner of Awaiiti 1H 2A 3 in Block III, Waitoa Survey District; thence south-easterly generally and south-westerly generally along the boundary of the Thames Valley Drainage District as described in Gazette, 1953, page 1554, to the point of commencement.

THIRD SCHEDULE
BOUNDARIES OF THAMES VALLEY DRAINAGE DISTRICT
ALL that area in the South Auckland Land District in Hauraki Plains, Matamata, and Piako Counties, and Matamata Borough bounded by a line commencing at the westernmost corner of Lot 1, D.P. S. 3714, in Block XIV, Waihou Survey District, and proceeding north-easterly along the north-western boundary of the said Lot 1 and that boundary produced to and southerly generally along the eastern side of the Elstow Canal Reserve shown on S.O. 24202 (sheet 2) to and along the southern and eastern boundaries of Section 15, Block XV, Waihou Survey District (Awaiiti Canal), to its easternmost corner; thence along a right line across Awaiiti 1J 2B 1B 2B 2C 2 and Awaiiti South Road to the north-western corner of part Awaiiti 1J 2B 2B; thence still southerly generally along the eastern side of the aforesaid road and along a right line being that roadside produced to and along the eastern boundary of Section 18, Block XV aforesaid, to its south-eastern corner; thence along a right line to the westernmost corner of Awaiiti 1H 2B 1; thence along the south-western boundary of the said 1H 2B 1 and the south-western and south-eastern boundaries of Awaiiti 1H 2B 2B to the left bank of the Waihou River in Block IV, Waitoa Survey District; thence south-easterly generally along the said left bank to its intersection with the boundary of Te Aroha Borough; thence along the south-western boundary of Te Aroha Borough as described in Gazette, 1917, page 1868, to and along the left bank of the Waihou River to a point in line with the northern side of a public road forming the southern boundaries of Sections 37, 36, 35, 34, 33, 32, and part 23, Block XI, Aroha Survey District, and Lot 1, D.P. 35889; thence westerly along a right line to and along that northern roadside and its production to the western side of the Te Aroha-Waharoa road; thence southerly generally along that western roadside to and along the northern boundary of part Section 4, Block I, Wairere Survey District, shown on D.P. 2399 for a distance of 20 chains; thence along a right line to a point on the northern side of Steeles Road 14 chains distant from its intersection with the Te Aroha-Waharoa road; thence along the northern side of Steeles Road and the western side of the Te Aroha-Waharoa road for a distance of 38 chains; thence due west to the western boundary of part Section 8, Block I aforesaid, shown on D.P. 2320; thence southerly along that western boundary to and westerly along the northern side of School Road to and south-easterly along the north-eastern side of Piraunui Road to and north-easterly along the south-eastern side of Parker Road and along a right line across the Te Aroha-Waharoa road to and along the south-eastern side of a public road intersecting Section 2, Block VI, Wairere Survey District, and forming the south-eastern boundary of Lot 1, D.P. 3038, to a point in line with the eastern boundary of the said Lot 1; thence northerly along a right line across the aforesaid road to and along the said eastern boundary and along another right line across School Road to the south-eastern corner of Lot 2, D.P. 27423; thence north-easterly along the south-eastern boundary of the said Lot 2 to and northerly along the western side of Stanley Road to a point in line with the south-eastern boundary of part Section 74, Block II, Wairere Survey District, shown on D.P. 1435; thence north-easterly along a right line across Stanley Road to and along the aforesaid south-eastern boundary and its production to and south-easterly generally along the left bank of the Waihou River to a point in line with the south-eastern boundary of Section 4, Block X, Wairere Survey District; thence south-westerly along a right line to the northernmost corner of Lot 1, D.P. 23293; thence southerly generally along the generally western side of Tower Road to and along the north-eastern side of Stock Road in the Borough of Matamata and that last-mentioned roadside produced to the western side of the Rotorua-Auckland Railway; thence along the western side of the said railway to a point in line with the north-eastern boundary of Section 6, Block I, Matamata Township; thence along a right line to and along that north-eastern boundary and the north-eastern boundaries of Sections 5, 4, 3, and 2 of the said Block I and the north-eastern and north-western boundaries of Section 1 of the said Block I and along a right line being the last-mentioned boundary produced across Peria Road to and along the north-western boundary of Section 9, Block II, Matamata Township, and along the south-western boundaries of the said Section 9 and Sections 10, 11, 12, and 13, Block II aforesaid, to and along the western boundaries of Sections 1, 2, 3, 4, 5, 6, 7, and 8, Block II aforesaid, to the south-western corner of the last-mentioned section; thence along the northern boundaries of Lots 11 and 12, D.P. 12072, crossing the intervening Comber Street and along the north-western boundaries of the said Lot 12 and Lot 13, D.P. 12072, Lot 1, D.P. S. 313, and Lot 1, D.P. 12828, crossing the intervening Elizabeth Street to and along the south-western boundaries of the said Lot 1 and Lots 8 and 11, D.P. 35415, along the southern end of Browne Street and the south-western boundaries of Lot 5, D.P. 28668, and Lot 12, D.P. 6974, and along a right line being the last-mentioned boundary produced to the western side of the Rotorua-Auckland Railway; thence still south-westerly generally along the western side of the said railway to a point in Block VI, Tapapa Survey District, in line with the north-western side of a public road forming the south-eastern boundaries of Sections 52, 53, 54, parts Sections 99 and 98, Matamata Settlement; thence along a right line to and along that north-western roadside and northern side of State Highway No. 29 to a point in line with the south-western boundary of Section 96A, Matamata Settlement, in
