PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Waitomo County Council stopping the portions of road described in the Schedule hereto.

Portion of the South-western Side of Charlotte Street and Portion of the South-eastern Side of Highgate in the City of Dunedin, Exempted from the Provisions of Section 128 of the Public Works Act 1928, Subject to Conditions as to the Building Line

Present:
THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Dunedin City Council on the 6th day of February 1961, and set out in the First Schedule hereto, in so far as it affects the sides and portions of the streets described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Charlotte Street, and first described in the Second Schedule hereto, within a distance of 15 ft from the side line of the said portion of street and the land fronting the south-eastern side of Highgate, secondly described in the Second Schedule hereto, within a distance of 33 ft from the centre line of the said portion of street.

FIRST SCHEDULE
THE Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the south-western side of the portion of Charlotte Street and the south-eastern side of Highgate adjoining part Lot 1, D.P. 1554, being part Section 25, Block IV, Upper Kaikorai Survey District, being part of the land in certificate of title, Volume 146, folios 274 and 275, Otago Land Registry.

SECOND SCHEDULE
The south-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Charlotte Street, fronting part Lot 1, D.P. 1554, being part Section 25, Block IV, Upper Kaikorai Survey District.
The south-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Highgate, fronting part Lot 1, D.P. 1554, being part Section 25, Block IV, Upper Kaikorai Survey District.
As the same are more particularly delineated on the plan marked M.O.W. 2163 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after this Order in Council, become Government road.

ALL that piece of road containing 2 roods 8·3 perches, situated in Block IX, Motu Survey District, Gisborne R.D., and adjoining or passing through part Section 2; as the same is more particularly delineated on the plan marked P.W.D. 160628 (S.O. 5045) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

Authorising the Laying Off of New Streets off Regent and Ethel Streets in the City of Invercargill, Subject to a Condition as to the Building Line

THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL
PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Invercargill City Council to permit the laying off of the proposed new streets described in the Schedule hereto at a width for parts of their length of less than 66 ft, but not less than 40 ft, subject to the condition that no building or part of a building shall at any one time be erected on the land shown edged green on the plan marked M.O.W 2478 (excepting the recreation reserve described as Lot 49 on the said plan) referred to in the said Schedule within a distance of 15 ft from the side lines of the said new streets.
