Declaring Road in Block I, Maramarua Survey District, to be Government Road

ORDER IN COUNCIL

At the Government Buildings at Wellington this 21st day of November 1960

Present:

THE RIGHT HON. W. NASH, C.H., PRESIDING IN COUNCIL

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall on and after the date of this Order in Council become Government road.

SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL that piece of road containing 0·5 perches situated in Block I, Maramarua Survey District, Auckland R.D., adjoining parts Allotments 8 and 9, Section 3, Town of Mercer; as the same is more particularly delineated on the plan marked M.O.W. 1568 (S.O. 42465) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

The Northern Side of Portion of Cowan Street in the City of Auckland, Exempted from the Provisions of Section 128 of the Public Works Act 1928

At the Government House at Wellington this 30th day of November 1960

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Auckland City Council on the 17th day of October 1960, and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto.

FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT

THE Auckland City Council, being the local authority having control of the streets of the City of Auckland, by resolution declares that the provision of section 128 of the Public Works Act 1928 shall not apply to portion of the northern side of Cowan Street fronting a subdivision of part Allotment 21, part Section 8, Suburbs of Auckland, and more particularly shown coloured red on plan A. 2725.

SECOND SCHEDULE

NORTH AUCKLAND LAND DISTRICT

THE northern side of all that portion of Cowan Street in the City of Auckland, fronting a subdivision of part Allotment 21, Section 8, Suburbs of Auckland.

As the same is more particularly delineated on the plan marked M.O.W. 1610 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Amending an Order in Council Appointing Five Non-elective Members of the Southland Catchment Board

PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 3rd day of August 1949 and published in Gazette, 4 August 1949, Vol. II, page 1626, appointing five non-elective members of the Southland Catchment Board, by deleting “Resident Engineer, Ministry of Works, Invercargill”, and substituting “District Commissioner of Works, Dunedin”.

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the additional land described in the Schedule hereto being taken for a public school.

HAWKE’S BAY LAND DISTRICT

ALL that piece of land containing 10 acres situated in the Borough of Waipukurau, Hawke’s Bay R.D., and being part Lots 9 and 10, Deeds Plan 286, being part Block 16, Waipukurau Crown Grant District; as the same is more particularly delineated on the plan marked P.W.D. 160810 (S.O. 3186) deposited in the office of the Minister of Works at Wellington, and thereon coloured blue.

PURSUANT to the Municipal Corporations Act 1954, as amended by section 2 of the Municipal Corporations Amendment Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the closing of the portion of the street known as Nott Street, in the City of Napier, described in the Schedule hereto.

HAWKE’S BAY LAND DISTRICT

ALL that portion of street containing 4·7 perches situated in the City of Napier, Hawke’s Bay R.D., adjoining part Town Section 54, Westshore; as the same is more particularly delineated on the plan marked M.O.W. 1553 (S.O. 3256) deposited in the office of the Minister of Works at Wellington and thereon coloured green.

Authorising the Laying Off of a Street off Rifle Range Road in the City of Hamilton, Subject to a Condition as to the Building Line

At the Government House at Wellington this 30th day of November 1960

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Hamilton City Council to lay off the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft, but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on a subdivision of the land shown edged green on the plan marked M.O.W. 1601 referred to in the Schedule hereto fronting the proposed street within a distance of 15 ft from the side lines of the said street.

SOUTH AUCKLAND LAND DISTRICT

THAT proposed street containing 2 roods 17·8 perches, being part Lots 1, 4, 6, 8, 10, 13, 16, and 21, D.P. S. 6288, being part Allotments 6, 10, and 394, Parish of Te Rapa; as the same is more particularly delineated on the plan marked M.O.W. 1601 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
