Authorising the Tourist Hotel Corporation of New Zealand
to Use Water for the Purpose of Generating Electricity and
to Erect and Use Certain Electric Lines at Franz Josef
Glacier

At the Government House at Wellington this 13th day of
July 1960
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, hereby grants to the Tourist Hotel
Corporation of New Zealand (hereinafter referred to as the
licensee) a licence, subject to the conditions hereinafter set
forth, to take and use from the Atupau River (hereinafter
referred to as the said stream), situated in Block XII, Waiho
Survey District, in the County of Westland, for the purpose
hereinafter set forth, a stream of water not exceeding 20 cubic
feet per second at any one time and to lay, construct, put
up, place, and use the electric lines hereinafter described, also
such further lines as may be necessary for the supplying of
electricity within the area of supply hereinafter defined.
CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by the
Water Power Regulations 1934 and the Electrical Supply
Regulations 1935 shall be incorporated in and shall form part
of this licence, except in so far as the same may be inconsistent
with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS - This licence is issued under the Water Power Regulations
1934, and is subject thereto, and to the Electrical Supply Regu-
lations 1935 and the Electrical Wiring Regulations 1935, and
to any regulations hereafter made in amendment thereof or in
substitution therefor.
UTILISATION OF WATER AND LOCATION OF HEADWORKS - Water shall be used under this licence solely for the
purpose of generating electricity, and shall be taken from the
said stream at the point in Block XII, Waiho Survey District,
indicated on the plan marked P.W.D. 96643 deposited in the
office of the New Zealand Electricity Department at Welling-
ton.
GENERAL DESCRIPTION OF WORKS AND AREA OF SUPPLY - The licensee is hereby authorised, subject to the conditions
hereof, to construct, maintain, and use the following works
for the purposes of this licence, the positions of the said works
being indicated on the said plan P.W.D. 96643.
(a) Headworks consisting of dam and intake, with water-race,
tunnels and pipeline leading to the water wheel and
powerhouse hereinafter referred to, giving a static
head of approximately 150 ft.
(b) Water wheel and powerhouse with all necessary equip-
ment for generating electricity, situated in Block XII,
Waiho Survey District.
(c) Tail race leading from the said water wheel back to the
said stream.
(d) Electric lines leading from the powerhouse aforesaid
across part Blocks XII, XI, and VIII; thence across
and along an unformed road in the Waiho Township;
thence across the main road to the licensee's premises
and shown by means of a black line on the said plan,
and also such further lines as may from time to time
be necessary for the supplying of electrical energy
within a radius of 20 chains of the Glacier Hotel,
situated in the Township of Waiho, such area being
shown bordered red on plan P.W.D. 98013 deposited
in the office of the New Zealand Electricity Depart-
ment at Wellington.
DURATION OF LICENCE - This licence shall, unless sooner determined, continue in
force until the 31st day of March 1981.
SYSTEM OF SUPPLY - The system of supply shall be as described in paragraphs
(a), (d), and (f) of clause 21-01 of the Electrical Supply
Regulations 1935. The generating voltage shall be 400 volts
and transmission voltage shall be approximately 11,000 volts
alternating current between phases.
RENTAL - For the purpose of assessing the rental or annual sum
payable in respect of the licence, the maximum generating
capacity of the plant at the commencement of this licence
is 150 kilowatts.
PROTECTION OF BIRDS AND WILD ANIMAL LIFE - The licensee or his assigns shall not do or permit any of
their servants, agents, or workmen to do anything in pur-
suance of this licence which may cause the destruction of birds
or of any form of wild animal life.
Trees Not to be Felled or Branches Removed Except by
Consent - The headworks and pipelines shall be so constructed and
at all times maintained by the licensee so that no damage or
disfigurement shall be done to or suffered by the scenic reserve.
No trees shall be felled or branches removed in connection
with the construction or maintenance of any works (including
transmission lines) without the prior consent in writing of the
Commissioner of Crown Lands for the district being first had
and obtained, and the Commissioner may, in granting such
consent, impose such conditions as he may consider necessary.
LICENSEE SHALL PROTECT BUSH AND TREES FROM FIRE - The licensee shall take all reasonable precautions to
protect the bush and trees on the scenic reserve from fire.
LICENSEE RESPONSIBLE FOR DAMAGE TO BUSH - The licensee shall be responsible for any damage to the
bush and/or trees on the scenic reserve from fire, or otherwise,
caused by the licensee or his employees, agents, or workmen.
No Right to Water Conferred - Nothing in this licence shall of itself confer upon the
licensee any right to water.

Declaring Road in Block VIII, Hokianga Survey District,
to be Government Road

July 1960

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 112 of the Public Works Act 1928,
His Excellency the Governor-General, acting by and
with the advice and consent of the Executive Council,
hereby orders and declares that the portion of road described
in the Schedule hereto shall, on and after the date of this
Order in Council, become Government road.

NORTH AUCKLAND LAND DISTRICT
All that piece of road containing 2 roods 16Β·1 perches,
situated in Block VIII, Hokianga Survey District, Auckland
R.D., adjoining or passing through Waimamaku B No. 2c No.
2B, Waimamaku B No. 2c No. 2A, and Waimamaku B No. 2c No.
1 Blocks; as the same is more particularly delineated on the
plan marked M.O.W. 367 (S.O. 41721) deposited in the office
of the Minister of Works at Wellington, and thereon coloured
green.

shall, on and after the date of this Order in Council, become
Government road.
