Declaring Road in Block XVI, Purua Survey District, to be Government Road

ORDER IN COUNCIL
At the Government House at Wellington this 13th day of January 1960
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

SCHEDULE
NORTH AUCKLAND LAND DISTRICT
ALL that piece of road containing 2 acres 3 roods 14·1 perches, situated in Block XVI, Purua Survey District, Auckland R.D., and adjoining part Tauranga Kotuku Block and Lot 1, D.P. 20389, being part Section 5; as the same is more particularly delineated on the plan marked P.W.D. 160858 (S.O. 31863) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

Declaring Road in Block I, Rotoma Survey District, Tauranga County, to be County Road

At the Government House at Wellington this 20th day of January 1960
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become county road.

SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
ALL that portion of road situated in Block I, Rotoma Survey District, Tauranga County, commencing 1 chain west of the northernmost corner of Section 12 of the aforesaid Block I, and proceeding thence in a south-easterly direction generally for a distance of approximately 94 chains and terminating at its junction with a public road.
As the same is more particularly delineated on the plan marked P.W.D. 160771 (S.O. 36828) deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B.

The Southern Side of Portion of Earle Street and the Eastern Side of Bath Street in the City of Auckland, Exempted from the Provisions of Section 128 of the Public Works Act 1928

At the Government House at Wellington this 20th day of January 1960
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Auckland City Council on the 24th day of August 1959, and set out in the First Schedule hereto, in so far as it affects the sides and portions of street described in the Second Schedule hereto.

FIRST SCHEDULE
NORTH AUCKLAND LAND DISTRICT
THE Auckland City Council being the local authority having control of the streets in the City of Auckland by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to portion of the southern side of Earle Street and portion of the eastern side of Bath Street, fronting part Allotment 64, Section 1, Suburbs of Auckland, comprised in certificate of title, Volume 584, folio 115, and more particularly shown coloured red on plan A. 2595/2.

SECOND SCHEDULE
NORTH AUCKLAND LAND DISTRICT
THE southern side of all that portion of Earle Street in the City of Auckland, fronting part Allotment 64, Section 1, Suburbs of Auckland.
The eastern side of all that portion of Bath Street in the City of Auckland, fronting part Allotment 64, Section 1, Suburbs of Auckland.
As the same are more particularly delineated on the plan marked P.W.D. 160588 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Eastern Side of Portion of Laxon Terrace and the Northern Side of Young’s Lane in the Borough of Newmarket, Exempted from the Provisions of Section 128 of the Public Works Act 1928, Subject to a Condition as to the Building Line

At the Government House at Wellington this 20th day of January 1960
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby approves of the resolution passed by the Newmarket Borough Council on the 16th day of September 1959 and set out in the First Schedule hereto, in so far as it affects the sides of the streets described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Laxon Terrace and the northern side of Young’s Lane (described in the Second Schedule hereto) within a distance of 25 ft from the centre line of the said portion of street.

THE Newmarket Borough Council being the local authority having control of the streets in the Borough of Newmarket by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the eastern side of portion of Laxon Terrace and the northern side of Young’s Lane fronting Allotments 36 and 37, part Allotments 17, 18, 19, 21, and 35, Section 4, and part Allotment 2, Section 14, Suburbs of Auckland, certificates of title, Volume 581, folio 57, Volume 715, folio 89, Volume 649, folio 23, Volume 603, folio 265, Volume 738, folio 252, Volume 730, folio 245, Volume 530, folio 299, Volume 671, folio 215, and Volume 581, folio 305, Auckland Registry.

SECOND SCHEDULE

THE eastern side of portion of Laxon Terrace in the Borough of Newmarket, fronting part Allotments 21 and 35, Section 4, Suburbs of Auckland.
