Declaring Road in Block VII, Tarawera Survey District,
Rotorua County, to be County Road

ORDER IN COUNCIL

At the Government House at Wellington this 4th day of
May 1960

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL

PURSUANT to section 112 of the Public Works Act 1928, His
Excellency the Administrator of the Government, acting by
and with the advice and consent of the Executive Council,
hereby orders and declares that the portion of road described
in the Schedule hereto shall, on and after the date of this
Order in Council, become county road.

SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

ALL that portion of road situated in Block VII, Tarawera
Survey District, Rotorua County, commencing at a public
road near the easternmost corner of Section 25 of the afore-
said Block VII and proceeding thence in a westerly direction
generally for a distance of approximately 12 chains and
terminating at the westernmost corner of Section 16 of the
aforesaid Block VII; as the same is more particularly de-
lineated on the plan marked P.W.D. 161495 (S.O. 39072)
deposited in the office of the Minister of Works at Welling-
ton, and thereon coloured red and marked A–B.

Consenting to Stopping Road in Block XIII, Waipukurau
Survey District, Waipawa County

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL

PURSUANT to section 149 of the Public Works Act 1928, His
Excellency the Administrator of the Government, acting by
and with the advice and consent of the Executive Council,
hereby consents to the Waipawa County Council stopping the
road described in the Schedule hereto.

SCHEDULE

HAWKE’S BAY LAND DISTRICT

ALL that piece of road containing 1 acre and 30 perches,
situated in Block XIII, Waipukurau Survey District, Waipawa
County, Hawke’s Bay R.D., and adjoining or passing through
part Lot D.P. 4088, being part Section 11, and part Block
207, Ruataniwha Crown Grant District; as the same is more
particularly delineated on the plan marked P.W.D. 161357
(S.O. 3181) deposited in the office of the Minister of Works
at Wellington, and thereon coloured green.

Consenting to the Closing of Portion of Smith Street in the
City of Auckland

IN COUNCIL

PURSUANT to the Municipal Corporations Act 1954, as
amended by section 2 of the Municipal Corporations Amend-
ment Act 1956, His Excellency the Administrator of the
Government, acting by and with the advice and consent of
the Executive Council, hereby consents to the closing of the
portion of the street known as Smith Street, in the City of
Auckland, described in the Schedule hereto.

SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL those pieces of street situated in Block XVI, Waitemata
Survey District, City of Auckland, Auckland R.D., described
as follows:

A. R. P. Adjoining
0 0 12·26} Parts Allotment 6 of Section 52, City of
0 0 4·42} Auckland
0 0 7·1 Part Allotment 5 of Section 52, City of
Auckland.

As the same are more particularly delineated on the plan
marked P.W.D. 161498 (S.O. 40713) deposited in the office
of the Minister of Works at Wellington, and thereon coloured
green.

Wellington, Exempted from the Provisions of Section 128
of the Public Works Act 1928, Subject to a Condition as
to the Building Line

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His
Excellency the Administrator of the Government, acting by
and with the advice and consent of the Executive Council,
hereby approves of the resolution passed by the Wellington
City Council on the 1st day of February 1960, and set out
in the First Schedule hereto, in so far as it affects the side
and portion of street described in the Second Schedule hereto,
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the side and
portion of street described in the Second Schedule hereto
within a distance of 25 ft from the centre line of the said
portion of street.

FIRST SCHEDULE

WELLINGTON LAND DISTRICT

THE Wellington City Council, being the local authority having
control of the streets in Wellington City, by resolution declares
that the provisions of section 128 of the Public Works Act
1928 shall not apply to the southern side of the portion of
Thule Street adjoining part Section 10, Ohiro District, being
part of the land in certificate of title, Volume 505, folio 101,
Wellington Registry, as is more particularly shown on the
plan annexed hereto.

SECOND SCHEDULE

WELLINGTON LAND DISTRICT

The southern side of all that portion of street situated in the
City of Wellington, known as Thule Street, fronting part
Section 10, Ohiro District; as the same is more particularly
delineated on the plan marked P.W.D. 161497 deposited in
the office of the Minister of Works at Wellington, and thereon
coloured red.
