FIRST SCHEDULE

THE Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the western side of the portion of Irvine Street adjoining part Section 10, Ohiro District, being part of the land in certificate of title, Volume 505, folio 101, Wellington Registry, as is more particularly shown on the plan annexed hereto.

SECOND SCHEDULE

WELLINGTON LAND DISTRICT

THE western side of all that portion of street situated in the City of Wellington, known as Irvine Street, fronting part Section 10, Ohiro District; as the same is more particularly delineated on the plan marked P.W.D. 161497 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Varying a Condition as to Setting Back the Building Line of Portion of a Street Known as Earl Street, in the Borough of Levin, Imposed by Special Order Under Section 186 of the Municipal Corporations Act 1954

IN COUNCIL

PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby amends the special order passed by the Levin Borough Council deposited in the Land Registry Office at Wellington as K. 43080, authorising the laying off of a street at a width of 50 ft subject to a building-line condition, by varying the said building-line condition imposed by the said special order in so far as it affects Lot 5, D.P. 19970 (C.T. 797/2), and Lot 9, D.P. 19970 (C.T. 800/5), so that no building or part of a building shall at any time be erected on the said land within a distance of 40 ft from the centre line of the said street.

Amending a Licence Authorising the New Zealand and Australian Land Co. Ltd. to Use Water for the Purpose of Generating Electricity

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby amends, as set forth in the Schedule hereto, the Order in Council dated the 3rd day of April 1957 and published in the Gazette on the 4th day of the same month, at page 578, authorising the New Zealand and Australian Land Co. Ltd. to use water for the purpose of generating electricity.

SCHEDULE

CLAUSE 5 of the conditions thereof is deleted, and the following clause is substituted therefor:

“SYSTEM OF SUPPLY

“5. The system of supply shall be as described in paragraphs (a), (d), and (f) of regulation 21–01 of the Electrical Supply Regulations 1935.”

PURSUANT to the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby consents to the assignment to Albert David Baker, of Coroglen, farmer, of the rights, powers, and privileges, under an Order in Council dated the 18th day of November 1957 and published in the Gazette on the 28th day of the same month, at page 2219, authorising Joseph Charles Minifie, of Mount Park, Coroglen, to use water for the purpose of generating electricity.

PURSUANT to the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, and with the consent of the licensee, hereby revokes the Order in Council dated the 24th day of February 1953 and published in the Gazette on the 5th day of March 1953, at page 285, authorising Frederick Chinn, of Waitaha, Ross, farmer, to use water for the purpose of generating electricity.

SCHEDULE

ALL that parcel of land situated in Block XVI, of the Christchurch Survey District, containing 1 acre 3 roods 1 perch, being Lot 1, on plan No. 19596, deposited in the Land Transfer Office at Christchurch, being part Rural Section 8, and being the lands comprised in deeds index 1 C/1, 100, and 101, Canterbury Registry.
