The Eastern Side of Portion of William Street, in the City of Wellington, Exempted from the Provisions of Section 128 of the Public Works Act 1928, Subject to a Condition as to the Building Line

ORDER IN COUNCIL
At the Government House at Wellington this 23rd day of December 1959

Present:

His Excellency the Governor-General in Council
Pursuant to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Wellington City Council on the 10th day of June 1959 and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the side and portion of street described in the said Second Schedule within a distance of 25 ft from the centre line of the said portion of street.

FIRST SCHEDULE

The Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the eastern side of the portion of William Street adjoining part Lot 19, D.P. 168, being all (or part) of the land in certificate of title, Volume 193, folio 181, Wellington Registry, as is more particularly delineated on the plan annexed hereto.

SECOND SCHEDULE

WELLINGTON LAND DISTRICT

The eastern side of all that portion of street situated in the City of Wellington, known as William Street, fronting part Lot 19, D.P. 168, being part Section 4, Evans Bay District; as the same is more particularly delineated on the plan marked P.W.D. 160481 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Jessie Street, in the City of Wellington, Exempted from the Provisions of Section 128 of the Public Works Act 1928

His Excellency the Governor-General in Council
Pursuant to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Wellington City Council on the 12th day of August 1959 and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto.

FIRST SCHEDULE

The Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the northern side of the portion of Jessie Street adjoining Lot 6, D.P. 811, being all (or part) of the land in certificate of title, Volume 161, folio 11, Wellington Registry, as is more particularly shown on the plan annexed hereto.

SECOND SCHEDULE

WELLINGTON LAND DISTRICT

The northern side of all that portion of street, situated in the City of Wellington, fronting Lot 6, D.P. 811, being part Section 249, City of Wellington; as the same is more particularly delineated on the plan marked P.W.D. 160278 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Declaring Road in Block V, Hunua Survey District, to be Government Road

At the Government House at Wellington this 23rd day of December 1959

Present:

His Excellency the Governor-General in Council
Pursuant to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

All those pieces of road situated in Block V, Hunua Survey District, Wellington R.D., described as follows:

1 0 7·8 Being road by Proclamation No. 6203, being formerly part Section 10; coloured blue, edged blue, on plan.
0 0 13·9 Being road by Proclamation No. 5820, being formerly part Section 12; coloured sepia, edged sepia, on plan.
1 1 1 Adjoining or passing through Sections 10, 11, and 12; coloured green on plan.

As the same are more particularly delineated on the plan marked P.W.D. 153353 (S.O. 23612) deposited in the office of the Minister of Works at Wellington, and thereon coloured as above mentioned.

Pursuant to the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.
