The Western Side of Portion of Lorne Street in the City of Auckland Exempted from the Provisions of Section 128 of the Public Works Act 1928

THE RIGHT HON. W. NASH, C.H., PRESIDING IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Auckland City Council on the 24th day of August 1959, and set out in the First Schedule hereto, in so far as it affects the side and portion of the street described in the Second Schedule hereto.

FIRST SCHEDULE
THE Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to part of the western side of Lorne Street fronting Allotments 53, 54, 55, and 56, Section 32, City of Auckland, comprised in certificates of title, Volume 795, folio 138, Volume 323, folio 81, and more particularly shown coloured red on plan A. 2596/2.

SECOND SCHEDULE
NORTH AUCKLAND LAND DISTRICT
THE western side of portion of Lorne Street in the City of Auckland, fronting Allotments 53, 54, 55, and 56, Section 32, City of Auckland; as the same is more particularly delineated on the plan marked P.W.D. 160587 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Varying a Condition as to Setting Back the Building Line of Portions of Stewart Street in the City of Christchurch, Imposed by Order in Council Under Section 117 of the Public Works Act 1908

Consent to the Establishment and Maintenance of an Aerodrome by the Dunedin City Council

PURSUANT to section 5 of the Local Authorities Empowering (Aviation Encouragement) Act 1929, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order may be cited as the Dunedin Aerodrome Establishment Order 1959.
  2. Consent is hereby given to the establishment and maintenance of an aerodrome by the Dunedin City Council at Momona in the Maungatua Survey District, Otago Land District.

Boundaries of County of Ashburton and Borough of Ashburton Altered

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. On and from the 1st day of April 1960, the areas described in the Schedule hereto are hereby excluded from the County of Ashburton and included in the Borough of Ashburton.
  2. The alteration of the boundaries of the said county and the said borough hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

SCHEDULE
ALL that area in the Canterbury Land District containing 90 acres, more or less, bounded by a line commencing at the intersection of the south-eastern side of Farm Road with the south-western side of Harrison Street, being a point on the boundary of the Borough of Ashburton as described in Gazette, 1955, page 1158, and proceeding northerly along a right line to the intersection of the middle lines of Harrison Street and Farm Road; thence north-easterly along the middle of Farm Road and south-easterly along the middle of Middle Road to a point in line with the south-eastern side of Allens Road; thence south-westerly and north-westerly along the boundary of the Borough of Ashburton aforesmentioned to the point of commencement.

Also all that area in the Canterbury Land District, containing 10 acres, more or less, bounded by a line commencing at the easternmost corner of Lot 5, Deposited Plan 11462, being a point on the boundary of the Borough of Ashburton as described in Gazette, 1955, page 1158, and proceeding south-easterly along the production of the north-eastern boundaries of Lots 4 and 5, Deposited Plan 11462, to the south-eastern boundary of part Lot 7, Deposited Plan 988; thence south-westerly along that boundary and the south-eastern boundary of Lot 6, Deposited Plan 15602, to the north-eastern side of Albert Street; thence north-westerly and north-easterly along the boundary of the Borough of Ashburton aforesmentioned to the point of commencement.
