Declaring Service Lanes to be Vested in the Corporation of the City of Auckland and to be Under the Control and Management of the Auckland City Council

At the Government Buildings at Wellington this 17th day of November 1959
Present:
THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL
PURSUANT to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the service lanes described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Citizens of the City of Auckland and be under the control and management of the Auckland City Council.

Amending the Representation on the Rangitikei Catchment Board

At the Government Buildings at Wellington this 10th day of November 1959
Present:
THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL
PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 13th day of December 1944 and published in Gazette, 14 December 1944, Vol. III, page 1504, declaring the number of members and apportioning representation on the Rangitikei Catchment Board by deleting the Schedule thereto, and substituting the following Schedule.

Validating Proceedings in Connection With the North Shore Drainage Board's Loan of £1,000,000
COBHAM, Governor-General ORDER IN COUNCIL
At the Government Buildings at Wellington this 10th day of November 1959
Present:
THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL
WHEREAS the North Shore Drainage Board is proceeding by way of special order to raise the sum of £476,000 being portion of a loan of £1,000,000 known as the Main Works Loan 1957:
And whereas the special order made by the said Board was irregular or defective in that, contrary to section 77 of the Municipal Corporations Act 1954 (the provisions whereof apply to the said special order by virtue of section 2 of the Local Authorities Loans Act 1956 and section 28 of the North Shore Drainage Act 1951):
(a) The resolution to raise the said sum was not passed at a special meeting;
(b) The said resolution was not confirmed at a subsequent meeting held within the period prescribed;
(c) No public notice of the place and date fixed for any subsequent meeting and of the purport of the resolution was given in the manner prescribed;
(d) No written notice under the hand of the secretary of the time and place of any subsequent meeting was given to each member of the Board in the manner prescribed:
And whereas it appears that the ratepayers of the district have not been misled by such irregularities or defects as aforesaid and it is expedient to validate the same: Now therefore, pursuant to section 130 of the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby orders and declares that the proceedings in connection with the raising of the said sum shall be valid to all intents and purposes as though the said special order had been made in accordance with the provisions of section 77 of the Municipal Corporations Act 1954, and hereby further orders and declares that the validity of the proceedings in connection with the raising of the said sum or of the security for the said sum shall not be questioned on the ground of the irregularities or defects aforesaid.

PURSUANT to the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.
