Reapportioning Representation on the Banks Peninsula Electric Power Board

ORDER IN COUNCIL

At the Government House at Wellington this 21st day of October 1959

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby determines as follows:

  1. This Order in Council shall come into force on the date of the next general election of members of local authorities.

  2. The Akaroa Riding of the Akaroa County shall be a separate constituent district of the Banks Peninsula Electric Power District.

  3. The Pigeon Bay, Okains Bay, Wainui, and Le Bons Bay Ridings of the Akaroa County shall be a separate constituent district of the Banks Peninsula Electric Power District.

  4. The constituent districts of the Banks Peninsula Electric Power District which are bracketed together in the first column of the Schedule hereto shall be a combined district for the purposes of the said Act.

  5. The local authority of the constituent district distinguished in the first column of the Schedule hereto by the letter “(P)” shall be the principal local authority of the said combined district.

  6. The number of representatives of each constituent district of the Banks Peninsula Electric Power District and of the said combined district on the Banks Peninsula Electric Power Board shall be the number specified in the Schedule hereto opposite the name of that constituent district and the said combined district.

  7. The first election of the representatives of the Akaroa Riding of the Akaroa County, and of the Pigeon Bay, Okains Bay, Wainui, and Le Bons Bay Ridings of the Akaroa County, and the first election of the additional representative of the said combined district shall be held on the date of the said next general election.

  8. The Order in Council dated the 29th day of June 1955 and published in the Gazette on the 30th day of the same month at page 1035, reapportioning representation on the Banks Peninsula Electric Power Board, is hereby revoked.

Boundaries of County of Levels and City of Timaru Altered

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. On and from the 1st day of November 1959, the areas described in the Schedule hereto are hereby excluded from the County of Levels and included in the City of Timaru.

  2. The alteration of boundaries of the said county and the said city hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

SCHEDULE

AREAS EXCLUDED FROM COUNTY OF LEVELS AND INCLUDED IN CITY OF TIMARU

FIRSTLY, all that area in the Otipua Riding containing 51 acres and 33 perches, more or less, bounded by a line commencing at the intersection of the left bank of Saltwater Creek with the south-eastern side of the Timaru-Dunedin State Highway 59 (King Street), being a point on the boundary of the City of Timaru as described in Gazette, 1957, page 1943, and proceeding north-westerly generally along the left bank of Saltwater Creek to the westernmost corner of Rural Section 1700 at the abutment of Mowbray Street, being a point on the boundary of the City of Timaru aforesaid; thence generally north-easterly, south-easterly, and south-westerly along the said city boundary to the point of commencement.

Secondly, all that area in the Otipua Riding containing 14 acres and 24 perches, more or less, bounded by a line commencing at the intersection of the south-western boundary of Lot 1, D.P. 11123, and the northern boundary of Reserve 1858 (aerodrome purposes, by Gazette, 1937, page 448), being a point on the boundary of the City of Timaru aforesaid, and proceeding north-westerly and north-easterly along the south-western and north-western boundaries of Lot 1, D.P. 11123, and the production of the last-mentioned boundary to the left bank of Saltwater Creek being a point on the boundary of the City of Timaru; thence generally south-easterly, southerly, and westerly along the said city boundary to the point of commencement.

Thirdly, all that area in the Claremont Riding, containing 3 acres 1 rood 11 perches, more or less, being Lot 2, D.P. 13096, situated in Block X, Arowhenua Survey District.

Fourthly, all that area in the Claremont Riding containing 16 acres and 28 perches, more or less, bounded by a line commencing at the intersection of the right bank of Otipua Creek and the southern side of Timaru-Cave Main Highway 118 (Claremont Road) being a point on the boundary of the City of Timaru aforesaid and proceeding easterly generally along the southern side of that road to the westernmost corner of Lot 3, D.P. 15727; thence south-easterly generally along the north-eastern boundaries of Lots 1, 4, and 5, D.P. 6369, and the eastern boundary of the last-mentioned lot to the north-western corner of Lot 1, D.P. 11505; thence south-easterly generally along the north-eastern boundary of that lot to the western boundary of Lot 4, D.P. 11505; thence northerly, easterly, and southerly along the western, northern, and eastern boundaries of Lot 4, D.P. 11505, to the north-western corner of Lot 3, D.P. 9476, being a point on the boundary of the City of Timaru aforesaid; thence southerly and north-westerly generally along the said city boundary to the point of commencement.

Fifthly, all that area in the Claremont Riding containing 1 acre and 24 perches, more or less, bounded by a line commencing at the north-eastern corner of Lot 3, D.P. 9476, being a point on the boundary of the City of Timaru aforesaid and proceeding northerly along the eastern boundary of Rural Section 4884 to the southern side of Waiti Road; thence easterly along that roadside to the boundary of the City of Timaru aforesaid; thence southerly along that boundary to the point of commencement.

Egbert Bethridge Topp, Esquire, of Wellington, New Zealand,

GREETING:

Pursuant to the Commissions of Inquiry Act 1908 and the Samoa Commissions of Inquiry Order 1927, I, Charles John, Viscount Cobham, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby extend to the 31st day of October 1959 the time within which you, as a Commission appointed by Order in Council dated the 22nd day of July 1959* to inquire into certain matters relating to public service salary and wage scales appropriate to Western Samoa, are required to report to me your findings and opinions on these matters.

And I declare that these presents are concurrent with and intended to be to the same effect as a Warrant extending the period within which you are so required to report, issued or to be issued by the High Commissioner of Western Samoa under the Samoa Commissions of Inquiry Ordinance 1921.

Given in Executive Council under the hand of His Excellency the Governor-General this 14th day of October 1959.
