HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Devonport Borough Council on the 20th day of May 1959, and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portion of street described in the Second Schedule hereto within a distance of 20 ft from the centre line of the said portion of street.

FIRST SCHEDULE
THE Devonport Borough Council, being the local authority having control of the streets in the Borough of Devonport, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the northern side of the Crown grant street fronting the subdivision of part of Allotment 17A, Section 2, Parish of Takapuna, being the land comprised in certificate of title, Volume 265, folio 288, Auckland Registry.

SECOND SCHEDULE
NORTH AUCKLAND LAND DISTRICT
THE northern side of all that portion of an unnamed street off Church Street in the Borough of Devonport, fronting part Allotment 17A, Section 2, Parish of Takapuna; as the same is more particularly delineated on the plan marked P.W.D. 158749 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Colin Edward Walker and Joan Walker, both of Ben Avon, Omarama, runholders (hereinafter referred to as the licensees), a licence, subject to the conditions hereinafter set forth, to take and use from Birch Creek (hereinafter referred to as the said stream), situated in Run 429A, Longslipside Survey District, in the County of Waitaki, for the purpose hereinafter set forth, a stream of water not exceeding 5 cubic feet per second, at any one time.

CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
- This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution herefor respectively.
UTILISATION OF WATER AND LOCATION OF HEADWORKS
- Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at a point in Run 429A, Longslipside Survey District, indicated on the plan marked N.Z.E.D. 521 deposited in the office of the New Zealand Electricity Department at Wellington.
GENERAL DESCRIPTION OF WORKS
- The licensees are hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan N.Z.E.D. 521.
(a) Headworks consisting of a dam and intake with a water race leading to the powerhouse hereinafter referred to, giving a static head of approximately 75 ft.
(b) Turbine and powerhouse with all necessary equipment for generating electricity, situated in Run 429A, Longslipside Survey District.
(c) Tail race leading from the said powerhouse back to the said stream.
SYSTEM OF SUPPLY
- The system of supply shall be as described in paragraph (d) of regulation 21–01 of the Electrical Supply Regulations 1935 and shall be an alternating current system.
DURATION OF LICENCE
- Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1980.
RENTAL
- For the purpose of assessing the rental or annual sum payable in respect of this licence, the maximum generating capacity of the plant at the commencement of this licence is 25 kilowatts.
NO RIGHT TO WATER CONFERRED
- Nothing in this licence shall of itself confer upon the licensees any right to water.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and with the consent of the licensee, hereby revokes the Order in Council dated the 2nd day of April 1941, and published in the Gazette on the 3rd day of the same month at page 806, authorising Francis Phency Arnold, of Lyell, labourer, to use water for the purpose of generating electricity, the rights, powers, and privileges under the said Order in Council having been assigned by the said Francis Phency Arnold to William Ernest James, of Lyell, roadman.
