Validating Proceedings in Connection With the Hokianga
County Council's Loan of £3,500

ORDER IN COUNCIL
At the Government Buildings at Wellington this 13th day of
April 1959
Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
WHEREAS the Hokianga County Council is proceeding by
way of special order to raise a loan of £3,500 to be known
as the Staff Housing Loan No. 2 1958; and whereas the
special order made by the said Council to raise the said loan
was irregular or defective in that, firstly, contrary to paragraph
(b) of section 87 of the Counties Act 1956, the resolution to
raise the said loan was confirmed at a subsequent meeting
held later than the 70th day after the special meeting at which
such resolution was passed, secondly, contrary to paragraph
(c) of section 87 aforesaid, the first public notification of the
date, time, and place fixed for the subsequent meeting and
the purport of the resolution was not given during the period
of 28 days immediately preceding the date of the subsequent
meeting, and thirdly, contrary to paragraph (c) aforesaid,
an interval of less than 14 days elapsed between the two
notifications specified in the said paragraph; and whereas it
appears that the ratepayers of the district have not been
misled by such irregularities or defects as aforesaid and it
is expedient to validate the same; now, therefore, pursuant to
section 130 of the Local Authorities Loans Act 1956, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby orders and
declares that the proceedings in connection with the raising
of the said loan shall be valid to all intents and purposes as
though the said special order had been made in accordance
with the provisions of paragraphs (b) and (c) of section
87 of the Counties Act 1956, and hereby further orders and
declares that the validity of the proceedings in connection
with the raising of the said loan or of the security for the
said loan shall not be questioned on the ground of the irregu-
larities or defects aforesaid.

Setting Apart Maori Freehold Land as a Maori Reservation

Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
PURSUANT to section 439 of the Maori Affairs Act 1953, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby sets apart
the Maori freehold land described in the Schedule hereto
as a Maori reservation for the purposes of a marae and
recreation ground for the Ngati-Rangi and Ngaitawake people
of the locality.

advice and consent of the Executive Council, hereby sets apart
the Maori freehold land described in the Schedule hereto as
a Maori Reservation for the purpose of a site for a Church of
England and a cemetery.

PURSUANT to section 21 of the Reserves and Other Lands
Disposal Act 1958, His Excellency the Governor-General,
acting by and with the advice and consent of the Executive
Council, hereby transfers and vests the control of the Waihi
Drainage Area, as described in subsection (13) of the afore-
said section 21, in the Tauranga County Council as from the
31st day of March 1959.

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
PURSUANT to the Rabbits Act 1955, His Excellency the
Governor-General, acting by and with the advice and con-
sent of the Executive Council, hereby makes the following
order.

ORDER

  1. (1) This order may be cited as the Waipiata-Patearoa
    Rabbit District Order 1959.
    (2) This order shall come into force on the day after the
    date of its notification in the Gazette.
  2. The boundaries of the Waipiata-Patearoa Rabbit District,
    which was constituted by Order in Council on the 13th
    day of September 1943,* are hereby altered and redefined;
    and, as from the commencement of this order, the boundaries
    of the said district shall be those specified in the Schedule
    hereto.

SCHEDULE
BOUNDARIES OF THE WAIPAITA-PATEAROA RABBIT DISTRICT
ALL that area in the Otago Land District, and Maniototo and
Taieri Counties containing 111,340 acres, more or less, bounded
by a line commencing at a point in the centre of the Taieri
River in line with the western boundary of Section 8,
Block XV, Maniototo Survey District; thence southerly to
and along that boundary and the western boundary of
Section 1, Block XV, aforesaid; thence easterly and southerly
along the northern and eastern boundaries of Section 22,
Block I, Rock and Pillar Survey District, to and north-
easterly along the northern boundary of Run 204c; thence
generally south-westerly along the south-eastern boundaries
of Runs 204c, 204d, 248J, 248K, 248L, and 248M; thence
generally northerly along the western boundary of Run 248M
to the southern corner of Run 308F; thence north-westerly
along the south-western boundary of Run 308F to and south-
westcrly along the south-eastern boundary of Run 308G; thence
north-westerly along the south-western boundary and gener-
ally north-easterly along the north-western boundary of Run
308G to the southern boundary of Run 308d; thence generally
north-easterly along the western boundary of Run 308D to
and generally north-easterly along the centre of the Taieri
River to the point of commencement.
