Authorising the Purchase by the North Canterbury Electric Power Board of Certain Electric Works from the New Zealand Electricity Department and the Construction of Further Electric Works

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL

PURSUANT to section 76 of the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the purchase by the North Canterbury Electric Power Board (hereinafter referred to as the Board) from the New Zealand Electricity Department (hereinafter referred to as the Department) of the electric works described in the First Schedule hereto, on the terms and conditions set forth in an agreement dated the 22nd day of May 1958, made between the Board and the Department; and, further, hereby authorises the construction by the Board of the electric works described in the Second Schedule hereto.

FIRST SCHEDULE

THE 33,000 volt single circuit transmission line now under construction leading from the Department’s substation at Waipara to the substation to be constructed by the Board described in the Second Schedule hereto.

SECOND SCHEDULE

A substation, consisting of a six-pole structure, transformer, switchhouse, and associated equipment, to be situated on the parcel of land containing approximately 24 perches in Ludstone Road, Township of Kaikoura, being Lot 1 on Deposited Plan No. 2480 in Block X, Mount Fyfe Survey District, Marlborough Land District.

Authorising Donald Stewart Blue, of Ohau Downs, Sheep Farmer, to Use Water for the Purpose of Generating Electricity

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Donald Stewart Blue, of Ohau Downs, sheep farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from the Wairepo Creek (hereinafter referred to as the said stream), situated in Run 544, Ohau Lake Survey District, in the County of Waitaki, for the purpose hereinafter set forth, a stream of water not exceeding 4 cubic feet per second at any one time.

CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.

UTILISATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at a point in Run 544 as indicated on the plan marked P.W.D. 98916 deposited in the office of the New Zealand Electricity Department at Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorised to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan P.W.D. 98916.

(a) Headworks consisting of a dam and intake with a water race and pipelines leading to the powerhouse herein-after referred to, giving a static head of approximately 25 ft.

(b) Water wheel and powerhouse with all necessary equipment for generating electricity, situated in Run 544, Ohau Lake Survey District.

(c) Tail race leading from the said powerhouse back to the said stream at a point in Run 543, Ohau Lake Survey District.

SYSTEM OF SUPPLY

  1. The system of supply shall be a direct current system as described in paragraph (d) of regulation 21-01 of the Electrical Supply Regulations 1935.

DURATION OF LICENCE

  1. Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1980.

RENTAL

  1. For the purpose of assessing the rental or annual sum payable in respect of this licence the maximum generating capacity of the plant at the commencement of this licence is 5 kilowatts.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the licensee any right to water.

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.
