Directing the Sale of Land in the City of Wellington

ORDER IN COUNCIL

At the Government House at Wellington this 22nd day of October 1958

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act 1928, I, Charles John, Viscount Cobham, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby direct the sale of the land described in the Schedule hereto, that land being no longer required for the purpose for which it was acquired.

SCHEDULE

ALL that piece of land in the Wellington Land District containing 2·76 perches, situated in the City of Wellington, being that part of Lot 242, D.P. 2644, included in Lot 1, D.P. 20699, being part Section 1, Harbour District. Part certificate of title, Volume 253, folio 41, Wellington Land Registry.

Validating Proceedings in Connection With the Inglewood County Council’s Loan of £20,000

At the Government Buildings at Wellington this 6th day of October 1958

THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL

WHEREAS the Inglewood County Council is proceeding by way of special order to raise a loan of £20,000 to be known as the Rural Housing Loan No. 4 1958:

And whereas the special order made by the said Council to raise the said loan was irregular or defective in that the two notifications required by paragraph (c) of Section 87 of the Counties Act 1956, although given twice with an interval of not less than 14 days between each, were not both given during the period of 28 days immediately preceding the date of the subsequent meeting confirming the resolution to raise the said loan:

And whereas it appears that the ratepayers of the district have not been misled by such irregularity or defect as aforesaid and it is expedient to validate the same:

Now, therefore, pursuant to section 130 of the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the proceedings in connection with the raising of the said loan shall be valid to all intents and purposes as though the said public notifications had been correctly given, and hereby further orders and declares that the validity of the proceedings in connection with the raising of the said loan, or of the security for the said loan, shall not be questioned on the ground of the irregularity or defect aforesaid.

Exempting Land in the North Auckland Land District from the Operation of Part III of the Coal Mines Act 1925

COBHAM, Governor-General

PURSUANT to the Coal Mines Act 1925, His Excellency the Governor-General hereby exempts the land described in the Schedule hereto from the operation of Part III of the Coal Mines Act 1925.

Lots 1 and 3, D.P. 45633, being part Allotments 76 and 77, Hikurangi Parish, situated in Block XVI, Hukerenui Survey District: Total area, 66 acres 3 roods 6·3 perches, more or less. Part certificate of title, Volume 890, folio 251, excepting thereout from the parts of Lots 1 and 3, being parts Allotment 76, all mines, layers, veins, seams, and strata of coal contained and described in certificate of title, Volume 507, folios 239 and 240; from the parts of Lots 1 and 3 aforesaid, being parts of Allotment 77, all mines, beds, and seams of coal and fireclay and all other minerals contained and described in certificate of title, Volume 503, folio 236, and deeds conveyances 250230 and 293607.
