Constituting Portion of the Kaitaia Drainage Area a Special Subdivision

ORDER IN COUNCIL
At the Government House at Wellington this 9th day of July 1958.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to subsection (1) of section 3 of the Swamp Drainage Amendment Act 1948, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby constitutes the land described in the Schedule hereto, being portion of the Kaitaia Drainage Area constituted by Order in Council dated the 7th day of March 1916, and published in Gazette of the 16th day of that month, a special subdivision to be known as the Ahipara Beach Township Special Subdivision.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT
THE Ahipara Beach Township of portion of the Rural Subdivision of the Kaitaia Drainage Area.
All that area in the North Auckland Land District in the Mangonui County bounded by a line commencing at a point being the northernmost corner of Section 35, Block IV, Ahipara Survey District, and proceeding south-easterly along the northern boundary of that Section 35, the end of Kakapo Road, the northern boundary of Section 36, along a right line being that boundary produced across Takahe Road and along the northern boundary of Section 89, to its easternmost corner; thence southerly generally along the south-eastern boundaries of Sections 89, 90, 91, 92, 93, and 94, the south-eastern end of Kaka Street, along the south-eastern boundaries of Sections 95, 96, 97, 98, 99, 100, 101, 102, 103, 104, and 105, the south-eastern end of Weka Street, the south-eastern boundaries of Sections 106, 107, 108, 109, 110, 111, 112, 113, 114, and 115, the south-eastern end of Kotare Street, the south-eastern boundaries of Sections 116, 117, 118, 119, 120, 121, 122, 123, 124, and 125, the south-eastern end of Kiwi Street, the south-eastern boundaries of Sections 126, 127, 128, 129, 130, 131, and 132, the south-eastern end of Moa Street, the south-eastern boundaries of Sections 133, 134, 135, 136, 137, 138, 139, 140, 141, and 142, the south-eastern end of Tui Street, and the eastern boundaries of Sections 143, 144, 145, 146, 147, 148, 149, and 150 to the southernmost corner of the last-mentioned Section; thence generally north-westerly along the southern boundary of that Section 150, to and along a right line being that boundary produced across Takahe Road, to and along the western side of the last-mentioned road, to and along the southern and western boundaries of Section 88, the western boundaries of Sections 87, 86, 85, and 84 and the south-western boundary of part Section 83; thence generally north-easterly along the north-western boundary of part Section 83, along a right line being the last-mentioned boundary produced across Tui Street, to and along the north-western boundaries of Sections 155, 82, 81, 80, 79, 78, 77; 76, 75, and 74, along another right line being the last-mentioned boundary produced across Moa Street, to and along the north-western boundaries of Sections 73, 72, 71, and 70, along the south-western, north-western, and north-eastern boundaries of Section 1, to and along the north-western end of Kiwi Street, along the north-western boundaries of Sections 2, 3, 4, 5, 6, 7, 8, 9, 10, and 11, along the north-western end of Kotare Street, the north-western boundaries of Sections 12, 13, 14, 15, 16, 17, 18, 19, 20, and 21, along the north-western end of Weka Street, the north-western boundaries of Sections 22, 23, 24, 25, 26, 27, 28, 29, 30, and 31, along the north-western end of Kaka Street and the north-western boundaries of Sections 32, 33, 34, and 35, the aforesaid Sections all being of Block IV aforesaid, to the point of commencement. As shown on the plan marked L. and S. 15/42/25A deposited in the Head Office, Department of Lands and Survey at Wellington, and thereon edged red.

Declaring Road in Block VI, Titirangi Survey District, to be Government Road

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

Varying a Condition as to Setting Back the Building Line of a Street Known as Karaka Road, in the Borough of Tauranga, Imposed by Order in Council Under Section 31 of the Municipal Corporations Amendment Act 1948 and Section 125 of the Public Works Act 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 131 of the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 20th day of December 1950, and published in Gazette, 11 January 1951, Vol. II, page 9, and deposited in the Land Registry Office at Auckland under No. S. 11183, authorising the Tauranga Borough Council to permit the laying off of, inter alia, the street known as Karaka Road in the Borough of Tauranga, by varying the conditions with regard to the building line imposed by the said Order in Council, so that no building or part of a building shall at any time be erected on Lot 119, D.P. 36698, being part Allotment 26, Te Papa Parish, within a distance of 46 ft from the centre line of the said street.

Directing Sale of Railway Land at Waipuku Under the Public Works Act 1928, Subject to a Certain Reservation

ORDER IN COUNCIL
At the Government House at Wellington this 9th day of July 1958
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby directs the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was acquired, reserving, however, to Her Majesty the Queen, full and free liberty, right, licence, and authority in perpetuity to construct, use, and maintain a water-pipe line across that portion of Section 310, Moa District, containing an area of 8·7 perches and shown coloured blue on the plan referred to in the Schedule hereto, together with the right of Her Majesty's agents and servants to enter on the said land from time to time and at all reasonable times to repair or renew the said pipe.
