Amending the Ohakune Borough Council Water Power and Electric Lines Licence 1955

At the Government Buildings at Wellington this 13th day of May 1958

Present:

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL

Pursuant to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Ohakune Borough Council Water Power and Electric Lines Licence 1955,* by revoking the said licence in so far as it operates as a licence to use water for the purpose of generating electricity but not in so far as it operates as a licence to lay, construct, put up, place, and use electric lines.

Consenting to Raising of Loans by Certain Local Authorities

Pursuant to the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

Validating Proceedings in Connection With the Lower Mangapiko Drainage Board's Loan of £5,000

WHEREAS the Lower Mangapiko Drainage Board (hereinafter called "the Board") is raising a loan of £5,000 to be known as the "Mangapiko Stream Improvement Loan 1957" (hereinafter called "the said loan"):

And whereas the proceedings in connection with the raising of the said loan have been irregular or defective in that the special order raising the said loan made by the Board, pursuant to section 34 of the Local Authorities Loans Act 1956, erroneously stated that the said loan was to be secured by a special rate made upon the whole of the Board's district instead of a special rate made upon the rateable (unimproved) value of all rateable property in the Te Rahu subdivision of the Board's district:

And whereas it appears that the ratepayers have not been misled by such irregularity or defect as aforesaid and it is expedient to validate the same:

Now, therefore, pursuant to section 130 of the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the proceedings in connection with the raising of the said loan shall be valid to all intents and purposes as though the said special order had stated that the said loan was to be secured by a special rate made upon the rateable (unimproved) value of all rateable property in the Te Rahu subdivision of the Board's district, and hereby further orders and declares that the validity of the proceedings in connection with the raising of the said loan or of the security for the said loan shall not be questioned on the ground of the irregularity or defect aforesaid.

Pursuant to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the land described in the Schedule hereto being taken, subject to memorandum of lease No. 19059, Auckland Land Registry, for the proper development and use of the said land and in particular to provide access into the community centre block adjoining thereto.

SCHEDULE

ALL that piece of land in the North Auckland Land District containing 1 rood 2 8 perches, situated in Block III, Titirangi Survey District, Borough of New Lynn, Auckland R.D., and being part Allotment 257, Waikomiti Parish; as the same is more particularly delineated on the plan marked P.W.D. 156067 (S.O. 39793) deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.

Pursuant to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Waipa County Council stopping the portions of road described in the Schedule hereto.

SCHEDULE

ALL those pieces of road in the South Auckland Land District, situated in Block XIII, Cambridge Survey District, Auckland R.D., described as follows:

A. R. P. Adjoining or passing through
0 1 35·5 Sections 4s and 5s, Norwegians Settlement; coloured green on plan.
0 0 35·5 Lot 4, D.P. 24014, being part Allotment 225, Pukekura Parish; coloured green, edged green, on plan.

Authorising the Laying Off of a Street (Albert Crescent) Off Albert Street in the City of Invercargill Subject to a Condition as to the Building Line

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL

Pursuant to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Invercargill City Council to lay off the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft. but not less than 40 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 155924 referred to in the Schedule hereto, within a distance of 15 ft. from the side lines of the said street.

SCHEDULE

THAT proposed street in the Southland Land District, containing by admeasurement 1 rood 0·6 perches, more or less, being part Section 26, Block I, Invercargill Hundred; as the same is more particularly delineated on the plan marked P.W.D. 155924 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
