Authorising the Nelson City Council to Use Water for the Purpose of Generating Electricity and to Erect Certain Electric Lines

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to the Nelson City Council (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from the Long Gully Creek (hereinafter referred to as the said stream), situated in Section 9, Block VIII, Waimea Survey District, for the purpose hereinafter set forth, a stream of water not exceeding one cubic foot per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.

CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.

UTILISATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at the point in Section 9, Block VIII, Waimea Survey District, indicated on the plan marked S.H.D. 17 deposited in the office of the State Hydro-electric Department at Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan S.H.D. 17:

(a) Headworks consisting of a dam and intake with pipe lines leading to the powerhouse hereinafter referred to, giving a static head of approximately 100 ft.

(b) Pelton wheel and powerhouse with all necessary equipment for generating electricity, situated in Section 9, Block VIII, Waimea Survey District.

(c) Tail race leading from the said powerhouse back to the said stream.

(d) Electric lines leading from the said powerhouse across Sections 9, 8, and 2, and across the Roding River and a public road, to a cottage situated in Section 2, all being situated in Block VIII, Waimea Survey District; the said lines being more particularly shown by means of black lines on the said plan S.H.D. 17.

SYSTEM OF SUPPLY

  1. The system of supply shall be as described in paragraph (j) of regulation 21-01 of the Electrical Supply Regulations 1935 and shall be a direct-current system at a normal rated pressure of 250 volts.

DURATION OF LICENCE

  1. Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1979, or until electrical energy is available from an Electric Power Board or other public source of supply, whichever is the earlier.

RENTAL

  1. For the purpose of assessing the rental or annual sum payable in respect of this licence, the maximum generating capacity of the plant at the commencement of this licence is 1·3 kilowatts.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the licensee any right to water.

Officer Authorised to Take Statutory Declarations

COBHAM, Governor-General

PURSUANT to section 301 of the Justices of the Peace Act 1927, His Excellency the Governor-General hereby authorises Samuel McDonald, being District Commissioner of Taxes and Stamp Duties, Whangarei, to take and receive statutory declarations under that section.

Exempting Land in the South Auckland Land District from the Operation of Part III of the Coal Mines Act 1925

PURSUANT to the Coal Mines Act 1925, His Excellency the Governor-General hereby exempts the land described in the Schedule hereto from the operation of Part III of the Coal Mines Act 1925.

PART Lots A, B, and C, D.P. 269, being parts Allotments 178 and 179, Whangamarino Parish, situated in Block X, Maramarua Survey District: Total area, 362 acres 3 roods 8·5 perches, more or less. Balance of certificate of title, Volume 387, folio 7. As shown on the plan deposited in the Head Office of the Mines Department at Wellington, and thereon edged red. (S.O. Plan 31336.)

Warrant Appointing the Air Services Licensing Authority Under the Air Services Licensing Act 1951

PURSUANT to section 3 of the Air Services Licensing Act 1951, I, Charles John, Viscount Cobham, the Governor-General of New Zealand, hereby appoint

Edward Denis Blundell, O.B.E., of Wellington, solicitor;
George Henry Lusk, of Palmerston North, solicitor;
William Henry Nankervis, F.P.A.(N.Z.), of Wellington, public accountant; and
Trevor Watts White, C.B.E., E.D., of Levin, retired Group Captain, R.N.Z.A.F.,

to be members of the Air Services Licensing Authority for a period of three years from the 17th day of February 1958:

And, pursuant to section 5 of the said Act, I further appoint you the said Edward Denis Blundell to be Chairman and you the said George Henry Lusk to be the Deputy of the Chairman of the said Air Services Licensing Authority.
