Christchurch Metropolitan Fire Board Election Order 1958

ORDER IN COUNCIL
At the Government Buildings at Wellington this 31st day of March 1958

Present:
THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL

PURSUANT to the Fire Services Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order prescribing the time and method of election of members of the Christchurch Metropolitan Fire Board:

  1. This order may be cited as the Christchurch Metropolitan Fire Board Election Order 1958.
  2. In this order:

“The Board” means the Christchurch Metropolitan Fire Board.

“City Member” means a member of the Board elected to represent the Christchurch City Council.

“Local Authority” means a local authority other than the Christchurch City Council, the district or part of the district of which is within the Christchurch Metropolitan United Urban Fire District.

“Local Authority Member” means the member of the Board elected to represent the local authorities as hereinbefore defined.

  1. There shall be three members of the Board elected to represent the Christchurch City Council and one member elected to represent, jointly, the Riccarton Borough Council, the Waimairi County Council, the Paparua County Council, the Heathcote County Council, and the Halswell County Council.

  2. For the first election under this order the Returning Officer shall be Seton Fulton Marshall and for subsequent elections the Returning Officer shall be the Secretary of the Board for the time being.

  3. The electors of the city members shall be the members of the Christchurch City Council.

  4. Every city member shall be elected by resolution passed at a meeting of the Christchurch City Council.

  5. The first election of city members shall be held on some day not later than the 30th day of April 1958 and the next election shall be held on some day in the month of February 1960 and subsequent elections shall be held on some day in the same month of every third year thereafter.

  6. In the case of an extraordinary vacancy in the office of a city member, the Returning Officer shall give notice in writing thereof to the Christchurch City Council, and an election to fill the office so vacated shall be held not later than one month after the date when such notice is given.

  7. It shall be the duty of the Mayor of the City of Christchurch to cause a meeting of the Christchurch City Council to be held for the purpose of conducting an election under this order whenever necessary.

  8. It shall be the duty of the Town Clerk of the Christchurch City Council immediately following an election by the Christchurch City Council under this order to give notice of the result thereof in writing to the Returning Officer, who shall notify the Minister of Internal Affairs accordingly.

  9. The first election of the local authority member shall take place by means of meetings to be held on some day in the month of April 1958 and the next election shall take place by means of meetings to be held on some day in the month of February 1960 and subsequent elections shall be held on some day in the same month of every third year thereafter.

  10. In the case of an extraordinary vacancy in the office of local authority member, an election shall take place by means of meetings to be held on some day not later than one month after the giving of the notice hereinafter required to be given by the Returning Officer.

  11. (a) Not later than the 10th day of April 1958, in the case of the first election of the local authority member, and
    (b) As soon as is practicable after the 30th day of November in every year immediately preceding the year in which an election of the local authority member is to take place, and
    (c) So soon thereafter as he has knowledge of any extraordinary vacancy in the office of the local authority member,—
    the Returning Officer shall give notice in writing of the necessary election to each of the local authorities and shall in such notice set out the number of votes exercisable by each of the local authorities.

  12. For the first election of the local authority member each local authority shall be entitled to exercise one vote for each complete one hundred pounds, or part thereof, of the payment made by that local authority to the Christchurch Fire Board in the year ending with the 31st day of March 1958, and for any subsequent election of the local authority member each local authority shall be entitled to exercise one vote for each complete one hundred pounds, or part thereof, of the contribution paid, or to be paid, by that local authority to the Board in the year in which that election is held.

  13. Each of the local authorities may nominate one candidate by resolution, a sealed copy of which, together with the written consent of each nominee to his nomination, shall be lodged with the Returning Officer not later than the 20th day of April 1958, in the case of the first election of the local authority member, and not later than the last day in January in every year in which an election of the local authority member is to take place and not later than ten days after the Returning Officer has given notice of an election to fill an extraordinary vacancy in the office of the local authority member.

  14. The Returning Officer shall thereupon prepare a list of nominated candidates and send a copy thereof to each of the local authorities, which shall, at a meeting held not later than the 30th day of April 1958, in the case of the first election of the local authority member or on some day in the month of February in every year in which an election of the local authority member is to take place or at a meeting held not later than one month after the Returning Officer has given
