Declaring Road in Block XI, Otahuhu Survey District to be Government Road

At the Government Buildings at Wellington this 24th day of March 1958

Present:

THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

SCHEDULE

ALL that piece of road in the North Auckland Land District containing 1 rood 6·6 perches, situated in Block XI, Otahuhu Survey District, Auckland R.D., and adjoining part Clendons Grant and part land on D.P. 6964, being part Clendons Grant; as the same is more particularly delineated on the plan marked P.W.D. 155631 (S.O. 40625) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

Authorising the Laying Off of a Street Off Riddell Road in the City of Auckland Subject to a Condition as to the Building Line

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Auckland City Council to permit the laying off of the proposed street, described in the Schedule hereto, at a width for part of its length of less than 66 ft., but not less than 40 ft., subject to the condition that no building or part of a building shall at any time be erected on a subdivision of the land shown edged green on the plan marked P.W.D. 155623 referred to in the said Schedule, within a distance of 15 ft. from the side line of the said street.

SCHEDULE

THAT proposed street in the North Auckland Land District, situated in the City of Auckland, containing by admeasurement 2 roods 23·3 perches, more or less, being part Lot 34, D.P. 17139 and part Lot 1, D.P. 44474, being part Allotments 20 and 21, District of Tamaki. As the same is more particularly delineated on the plan marked P.W.D. 155623 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section 186 of the Municipal Corporations Act 1954, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Taupo Borough Council to permit the laying off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 40 ft.

THAT proposed street in the South Auckland Land District, situated in Block II, Tauhara Survey District, Borough of Taupo, containing by admeasurement 1 rood 7 perches, more or less, being part Waipahihi No. 25 Block; as the same is more particularly delineated on the plan marked P.W.D. 155483 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Rotorua Borough Council to permit the laying off of the proposed street described in the Schedule at a width for part of its length of less than 66 ft. but not less than 40 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 155624 referred to in the said Schedule within a distance of 45 ft. from the centre line of the said street.

SCHEDULE

THAT proposed street in the South Auckland Land District, Borough of Rotorua, containing by admeasurement 38·5 perches, more or less, being Lot 27, L.T. Plan S. 4873, being part Section 92, Suburbs of Rotorua; as the same is more particularly delineated on the plan marked P.W.D. 155624 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Western Side of Portion of Lambton Quay, and the North-western Side of Plimmers Steps, in the City of Wellington, Exempted from the Provisions of Section 128 of the Public Works Act, Subject to Conditions as to Building Line

At the Government Buildings at Wellington this 24th day of March 1958

THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolutions passed by the Wellington City Council on the 17th day of April 1957, and set out in the First and Second Schedules hereto, in so far as they affect the sides and portions of street described in the Third and Fourth Schedules hereto, subject to the condition that no shop with a public entrance to the street known as Plimmers Steps and no show window fronting that street displaying wares for sale shall at any time be erected or, if hereafter erected, be permitted to be used on the land fronting the north-western side of Plimmers Steps within a distance of 33 ft. from the centre line of that street, and to the further condition that no building with a public entrance to that portion of Plimmers Steps between the lowest step of the existing steps and the junction of Plimmers Steps with Boulcott Street shall at any time be erected, or if hereafter erected, be permitted to be used on the land fronting the north-western side of such street within a distance of 33 ft. from the centre line of that street, provided always that the erection of a building within the said distance of 33 ft. with one public entrance to Plimmers Steps at a distance of approximately 3¼ chains from the street known as Lambton Quay and the use of such entrance shall not be a breach of this further condition.

FIRST SCHEDULE

THE Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928, shall not apply to the western side of the portion of Lambton Quay adjoining part Reserve 5, Town of Wellington, being all (or part) of the land in certificate of title, Volume 433, folio 62, Wellington Registry; as is more particularly shown on the plan annexed hereto.

SECOND SCHEDULE

THE Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928, shall not apply to the north-western side of the portion of Plimmers Steps adjoining part Sections 512, 513, and part Reserve 5, Town of Wellington, being all (or part) of the land in certificate of title, Volume 433, folio 62, Wellington Registry; as is more particularly shown on the plan annexed hereto.
