Amending. Declaration of Land, Wellington Acclimatisation District, as a Wildlife Refuge

A PROCLAMATION
PURSUANT to section 14 of the Wildlife Act 1953, I, Major-General the Right Honourable Sir Harold Eric Barrowclough, the Administrator of the Government of New Zealand, hereby revoke the Warrant published in Gazette, 21 February 1929, Volume I, page 445, relating to the Wellington Acclimatisation District notifying and declaring certain areas to be sanctuaries under the Animals Protection and Game Act 1921–22, to the extent appearing in the First Schedule hereto; and I hereby proclaim and declare the areas described in the Second Schedule hereto to be wildlife refuges for the purposes of the Wildlife Act 1953.
FIRST SCHEDULE
AREAS REVOKED AS SANCTUARIES UNDER THE ANIMALS PROTECTION AND GAME ACT 1921–22

Land at Trentham, County of Hutt: All that piece or parcel of land, containing 670 acres 2 roods 14 perches, being Sections 86, 87, 88 (and part of a closed road), 211, 266, and 267, and part of Section 89, Hutt District, the part of Section 89 being bounded as follows: towards the north-east by other part of the said Section 89, 3041 links and 2068·1 links; towards the north-west by the Hutt River; towards the south-west by No. 2 Line (closed road), 5720 links; and on the south-east by the main road, 245·8 links, 420·3 links, and 374·5 links.

Totara and Kawhakahia Lakes, County of Horowhenua: All that area in the Wellington Land District, situated in Block V, Kaitawa Survey District, Horowhenua County, being Lakes Kawhakahia and Totara, and the areas enclosed by lines running parallel to and 5 chains distant from the shores of those lakes.

A lagoon at Kahautara: All that area in the Wellington Land District, situated in Blocks XI and XV, Wairarapa Survey District, being the lagoon lying partly in Kahautara No. 1B Block and partly in Subdivision 1c of Te Awaawaroa No. 1 Block.

Small islet lying to the north of Somes Island in Port Nicholson: The small islet lying to the north of Somes Island in Port Nicholson.

An area at Pāhiatua, the property of Mr Samuel Bolton: All that area in the Wellington Land District bounded by a line commencing at the confluence of the Manawatu and Mangatainoka Rivers and proceeding thence up the left bank of the Manawatu River to a point in line with the north-eastern boundary of Section 65 (road and river-bank protection reserve), Block I, Makuri Survey District; thence to and along that boundary to the south-eastern corner of the said Section 65; thence northerly along the road forming the south-eastern boundary of the said Section 65 to a point in line with the south-eastern boundary of Section 2A, Block I, Makuri Survey District; thence to and along that boundary and its production to the Tiraumea River; thence down the Tiraumea and Mangatainoka Rivers to the confluence of the Manawatu and Mangatainoka Rivers, the place of commencement.
SECOND SCHEDULE
AREAS DECLARED TO BE WILDLIFE REFUGES UNDER THE WILDLIFE ACT 1953
- Land in the County of Hutt, Wellington Land District:
(1) Part Section 88, Hutt District, being Lot 1, Deposited Plan 15565: Area, 30 acres 2 roods 4 perches, more or less. (Certificate of title, Volume 575, folio 115.)
(2) Part Section 87, Hutt District: Area, 1 rood 26·2 perches, more or less. (Certificate of title, Volume 525, folio 11.)
(3) Parts of Sections 86 and 87, Hutt District, being also part of the land in Deposited Plan A/2415 and part of Lot 2, Deposited Plan 6601: Area, 133 acres 3 roods 30·51 perches, more or less. (Certificate of title, Volume 574, folio 152.) All situated in Block I, Rimutaka Survey District. As the same is more particularly shown on plan marked I.A. 52/365 deposited in the Head Office, Department of Internal Affairs, Wellington, and thereon edged red.

Lakes Kawhakahia and Totara and a strip of surrounding land, County of Horowhenua, Wellington Land District: All that area in the Wellington Land District situated in Block V, Kaitawa Survey District, being the lakes known as Kawhakahia Lake and Totara Lake and the land bounded by lines parallel to and 5 chains distant from the shores of the said lakes; all being part Subdivisions 1B 3 and 1A of Kukutauaki No. 1 Block and part Subdivisions 36 and 38 of Ngarara West A Block. As the same is more particularly shown on plan marked I.A. 52/308 deposited in the Head Office, Department of Internal Affairs, Wellington, and thereon edged red.

Lagoon in the County of Featherston, Wellington Land District: The lagoon, situated in Blocks XI and XV, Wairarapa Survey District, being part Subdivisions 1c 2, 1c 3, and parts 1c 6 and 1c 7 No. 1 of Awaawaroa No. 1 Block, and part of the land as shown on Deposited Plan No. 4396, being part Section 1, Kahutara Block. As the same is more particularly
shown on plan marked I.A. 52/377 deposited in the Head Office, Department of Internal Affairs, Wellington, and thereon edged red.

Mokopuna Island, Wellington Land District: Mokopuna Island situated in Block XIII, Belmont Survey District, and lying to the north of Somes Island in Port Nicholson. Area, 1 acre 3 roods 36 perches, more or less. As the same is more particularly shown on plan marked I.A. 52/34 deposited in the Head Office, Department of Internal Affairs, Wellington, and thereon edged red.

An area in the County of Pāhiatua, Wellington Land District: All that area in the Wellington Land District situated in Block I, Makuri Survey District, bounded by a line commencing at the junction of the right bank of the Tiraumea River and the left bank of the Manawatu River, being a point on the north-western boundary of a scenic reserve situated in Block I aforesaid; thence south-easterly up the left bank of the Manawatu River to a point in line with the north-eastern boundary of Section 65, Block I aforesaid; thence southerly generally to and along that boundary to the northern side of the Tiraumea Road; thence westerly along that road to a point in line with the south-eastern boundary of Section 2A, Block I aforesaid; thence south-westerly to and along that boundary and its production to the right bank of the Tiraumea River; thence down that bank to a point on the north-western boundary of a scenic reserve situated in Block I aforesaid, being the point of commencement. As the same is more particularly shown on plan marked I.A. 52/385 deposited in the Head Office, Department of Internal Affairs, Wellington, and thereon edged red.

Appointment of Tribunal of Inquiry

PURSUANT to section 25 of the Copyright Act 1913, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby appoints D. J. Dalglish, Esquire, Judge of the Compensation Court; N. Butcher, Esquire; Professor I. A. Gordon, M.A., PH.D., HON. LL.D.; and J. W. Miles, Esquire, LL.D., to be a tribunal to inquire into the rate of royalty payable by makers of records of musical works in which copyright subsists to the owners of copyright in those works. And does further appoint Judge D. J. Dalglish to be Chairman of the Tribunal.

Authorising the Laying Off of a Street Off Kohimarama Road in the City of Auckland Subject to a Condition as to the Building Line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Auckland City Council to permit the laying off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 45 ft., subject to the condition that no building or part of a building shall at any time be erected on a subdivision of the land shown edged green on the plan marked P.W.D. 153403 referred to in the said Schedule, within a distance of 33 ft. from the centre line of the said street.

THAT proposed street in the North Auckland Land District, situated in the City of Auckland, containing by admeasurement 3 roods 35·7 perches, more or less, being part Lot 1, D.P. 36183, and being part Allotment 27, District of Tamaki; as the same is more particularly delineated on the plan marked P.W.D. 153403 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
