ORDER IN COUNCIL

At the Government House at Wellington this 14th day of
August 1957

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL

PURSUANT to section 112 of the Public Works Act 1928, His
Excellency the Administrator of the Government, acting
by and with the advice and consent of the Executive Council,
hereby orders and declares that the portion of road described
in the Schedule hereto shall, on and after the date of this
Order in Council, become Government road.

SCHEDULE

ALL that piece of road in the Hawke’s Bay Land District
containing 3 roods 37·5 perches, situated in Block XIX,
Nuhaka North Survey District, Hawke’s Bay R.D., and
adjoining Section 7A and part Section 5; as the same is more
particularly delineated on the plan marked P.W.D. 154032
(S.O. 2980) deposited in the office of the Minister of Works
at Wellington, and thereon coloured green.

Authorising Thomas David Goodger, of Lindis Pass, Run-
holder, to Use Water for the Purpose of Generating
Electricity

ORDER IN COUNCIL

At the Government House at Wellington this 14th day of

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the
Administrator of the Government, acting by and with the
advice and consent of the Executive Council, hereby grants to
Thomas David Goodger, of Lindis Pass, Runholder (herein-
after referred to as the licensee), a licence, subject to the
conditions hereinafter set forth, to take and use from Long
Spur Creek (hereinafter referred to as the said stream), situ-
ated in Run 235c, Lindis Survey District, in the County of
Vincent, for the purpose hereinafter set forth, a stream of
water not exceeding 3 cubic feet per second at any one time.

CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by
    the Water Power Regulations 1934 and the Electrical Supply
    Regulations 1935 shall be incorporated in and shall form
    part of this licence, except in so far as the same may be
    inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. This licence is issued under the Water Power Regula-
    tions 1934, and is subject thereto, and to the Electrical Supply
    Regulations 1935, the Electrical Wiring Regulations 1935, the
    Radio Interference Regulations 1934, and to all regulations
    hereafter made in amendment thereof or in substitution
    therefor respectively.

UTILISATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the pur-
    pose of generating electricity and shall be taken from the said
    stream at the point in Run 235c, Lindis Survey District, indi-
    cated on the plan marked P.W.D. 92508 deposited in the office
    of the State Hydro-electric Department at Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorised, subject to the con-
    ditions hereof, to construct, maintain, and use the following
    works for the purpose of this licence, the positions of the
    said works being indicated on the said plan P.W.D. 92508:

(a) Headworks consisting of a dam and intake, with a
water race, surge tank, and pipeline leading to the
powerhouse hereinafter referred to, giving a static
head of approximately 55 ft.

(b) Water wheel and powerhouse with all necessary equip-
ment for generating electricity, situated in Run
237H, Lindis Survey District.

(c) Tail race leading from the said powerhouse back to
the said stream.

SYSTEM OF SUPPLY

  1. The system of supply shall be a direct-current system as
    described in paragraph (d) of regulation 21-01 of the Elec-
    trical Supply Regulations 1935.

DURATION OF LICENCE

  1. Unless sooner lawfully determined, this licence shall con-
    tinue in force until the 31st day of March 1978.

RENTAL

  1. For the purpose of assessing the rental or annual sum
    payable in respect of this licence, the maximum generating
    capacity of the plant at the commencement of this licence
    is 8 kilowatts.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the
    licensee any right to water.

Validating Proceedings in Connection with the Whakatane
Borough Council’s Loan of £12,500

At the Government House at Wellington this 7th day of
August 1957

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL

WHEREAS the Whakatane Borough Council proceeded by way
of special order to raise a loan of £12,500 known as the
Library Loan 1957 (hereinafter called “the said loan”); and
whereas the proceedings in connection with the said loan were
irregular or defective in that there was an interval of less than
fourteen days between the two notifications required by
paragraph (c) of section 77 of the Municipal Corporations
Act 1954; and whereas it appears that the ratepayers of the
district have not been misled by such irregularity or defect
as aforesaid and it is expedient to validate the same:

Now, therefore, pursuant to section 130 of the Local
Authorities Loans Act 1956, His Excellency the Administrator
of the Government, acting by and with the advice and consent
of the Executive Council, hereby orders and declares that the
proceedings in connection with the said loan shall be valid
to all intents and purposes as though an interval of not less
than fourteen days had elapsed between the two notifications,
and hereby further orders and declares that the validity of the
proceedings in connection with the said loan or of the security
for such loan shall not be questioned by reason only of the
irregularity or defect aforesaid.

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL

WHEREAS the Pukekohe Borough Council proceeded by way
of special order to raise a loan of £32,000 known as the
Municipal Chambers and Public Library Loan 1952 (herein-
after called “the said loan”); and whereas the proceedings in
connection with the said loan were irregular or defective in
that there was an interval of less than fourteen days between
the two notifications required by paragraph (c) of section 62
of the Municipal Corporations Act 1933 (as substituted by
section 5 (a) of the Municipal Corporations Amendment Act
1938); and whereas it appears that the ratepayers of the dis-
trict have not been misled by such irregularity or defect as
aforesaid and it is expedient to validate the same:

Now, therefore, pursuant to section 130 of the Local
Authorities Loans Act 1956, His Excellency the Administrator
of the Government, acting by and with the advice and consent
of the Executive Council, hereby orders and declares that the
proceedings in connection with the said loan shall be valid
to all intents and purposes as though an interval of not less
than fourteen days had elapsed between the two notifications,
and hereby further orders and declares that the validity of the
proceedings in connection with the said loan or of the security
for such loan shall not be questioned by reason only of the
irregularity or defect aforesaid.
