Directing Sale of Railway Land at Napier Under the Public Works Act 1928

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby directs the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was taken.

SCHEDULE

APPROXIMATE area of the piece of land directed to be sold: 1·95 perches.

Railway land, being part Town Section 549, Napier.

Situated in the City of Napier. (S.O. 2986.)

In the Hawke’s Bay Land District: as the same is more particularly delineated on the plan marked L.O. 14887 deposited in the office of the Minister of Railways at Wellington, and thereon coloured blue.

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

PURSUANT to the Rabbits Act 1955, His Excellency the Administrator of the Government, at the request of the Minister of Agriculture made on the recommendation of the Rabbit Destruction Council, and acting by and with the advice and consent of the Executive Council, hereby constitutes and declares the area of land, the boundaries of which are described in the Schedule hereto, being an area to which subsection (1) of section 14 of the Rabbits Act 1955 applies, a rabbit district, and appoints that the name of the said rabbit district shall be the Northbank Rabbit District, and orders that the basis on which the Rabbit Board to be established for the said district shall first levy its general rate shall be the acreage of the land occupied by the ratepayer.

SCHEDULE

BOUNDARIES OF THE NORTHBANK RABBIT DISTRICT

ALL that area in the Marlborough Land District, Marlborough County, containing approximately 54,500 acres, and bounded by a line commencing at the westernmost point of S.G.R. 121 in Block I, Mount Olympus Survey District; thence proceeding generally north-easterly by the north-western boundary of part S.G.R. 121 and the west boundary Section 1A, Block XV, Pine Valley Survey District, and continuing across a public road to the right bank of the Top Valley Stream; thence easterly by the said right bank to a point south-west of the north-western corner of Section 5, Block XVI, Pine Valley; thence north-easterly by a right line across the said stream and a public road to the said corner; thence north-easterly generally by the northern boundaries of Sections 5 and 6, Block XVI aforesaid, Sections 2 and 4, Block XVII, Pine Valley Survey District, and Section 4, Block XVIII, Pine Valley Survey District, to the western boundary of part Section 13, Block I, Kaituna Registration District; thence northerly, easterly, and southerly generally by the western, northern, and eastern boundaries of the said part Section to the north-western boundary of Section 8, Block XVIII, Pine Valley Survey District; thence generally north-easterly by the northern boundaries of Sections 8, 9, and 10, Block XVIII, Pine Valley Survey District, to the south-western boundary of Section 3, Block XIII, Pine Valley Survey District; thence easterly by the right bank of the said creek to a point in line with the western boundary of part S.G.R. 130; thence northerly across the said creek and a public road and by the said western boundary to the most north-western corner of the said part S.G.R. 130; thence south-easterly by the northern boundary and south-westerly by the eastern boundary of the said part S.G.R. 130 and its production across a public road and Quartz Creek to the right bank of the said creek; thence south-easterly by the said right bank to a point in line with the north-western boundary of the eastern portion of the said part S.G.R. 130; thence north-easterly across the said creek and a public road, to and along the north-western boundary of the said eastern portion of part S.G.R. 130, to the north-western corner of Run 141, Block X, Onamalutu Survey District; thence north-easterly generally by the northern boundary of the said Run 141 and its production across a public road to the right bank of the Criterion Creek; thence down the right bank of the said creek to its confluence with Bartletts Creek, and across that creek to the left bank; thence north-easterly by the said left bank to a point in line with the northern boundary of Run 141, Block X aforesaid; thence easterly generally across a public road to the said boundary; thence north-easterly and southerly generally by the northern and eastern boundaries of the said Run 141 to the northern boundary of Section 5, Block X, Onamalutu Survey District; thence easterly generally by the northern boundaries of the said Section 5, and Sections 9 and 2, Block X, Onamalutu Survey District, and Section 8, Block XI, Onamalutu Survey District, to the westernmost corner of Section 11, Block XI, Onamalutu Survey District; thence southerly generally by the eastern boundary of the said Section 6 to the north-western boundary of the southern part of Section 10, Block I, Kaituna Registration District; thence easterly generally by the northern boundary of the said part Section 10 to the western boundary of part Section 11, Block I, Kaituna Registration District; thence southerly and westerly generally by the eastern and southern boundaries of part Section 10 aforesaid to the eastern corner of Section 80, North Bank of Wairau Registration District; thence southerly generally across a public road and by the eastern boundaries of Section 174 of the aforesaid district and Section 18, Block XI, Onamalutu Survey District, to the western corner of Section 31, Kaituna Registration District; thence easterly and southerly generally by the northern and eastern boundaries of Section 31 aforesaid to the eastern corner of the said section; thence north-easterly across a public road and by the northern side of a public road to a point opposite the westernmost corner of Section 2, Block XII, Onamalutu Survey District; thence southerly by a right line across the said road to the westernmost corner aforesaid; thence north-easterly by the south-eastern boundary of Section 2, to and across a public road to its south side; thence easterly generally by the northern boundaries of part Sections 117, North Bank of Wairau R.D. 106, Kaituna R.D. 103, 1 of 65, 63, Sq. 29, and Section 101, Kaituna Valley R.D., crossing intervening roads to and across a public road on the east boundary of Section 101 aforesaid to its eastern side; thence south-easterly generally by the said east side to the westernmost corner of Section 53, Sq. 29, North Bank of Wairau R.D.; thence easterly generally by the northern boundary of Section 53, Sq. 29 aforesaid, to a point opposite the western boundary of Section 71, Kaituna Valley R.D.; thence north-westerly generally by a right line across a public road and by the western boundary of Section 71 aforesaid, easterly by the northern boundary of Section 71, and by a right line across a public road to the western boundary of part Section 73, Kaituna R.D.; thence northerly generally by the western boundaries of part Section 73 and Section 80, Kaituna R.D., and Section 7, Block V, Cloudy Bay Survey District, to the westernmost corner of Section 7 aforesaid; thence easterly, northerly, and easterly generally by the northern boundaries of Sections 7 and 9, Block V, Cloudy Bay Survey District, Section 13 and Lots 2 and 1, D.P. 862, Block VI, Cloudy Bay Survey District, to the easternmost corner of Lot 1 aforesaid; thence southerly generally by the eastern boundary of Lot 1 aforesaid to the southernmost corner of the said lot, and by a right line due south to the middle line of the Wairau River; thence south-westerly generally by the said middle line to a point opposite the south-western corner of Section 1, Block III, Mount Olympus Survey District; thence northerly by a right line to and across a public road to the said corner; thence northerly by the western boundary of Section 1 aforesaid, north-westerly by the south-western boundary of Section 4, Block IV, Mount Olympus Survey District, and westerly generally by the southern boundary of S.G.R. 121 to the westernmost corner of the said run and the place of commencement. Including therein the island in the Wairau River, being Section 3 of Sq. 30, Wairau Registration District, Blocks XIV and XV, Onamalutu Survey District.
