Setting Apart Tidal Land for Disposal Under Section 152 of the Harbours Act 1950

A PROCLAMATION
PURSUANT to the Harbours Leasing Regulations 1930, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto shall be set apart for disposal under section 152 of the Harbours Act 1950.

ALL that area in the North Auckland Land District containing by admeasurement 43 acres, more or less, being Section 7, Block IX, Russell Survey District. As the same is more particularly delineated on the plan marked M.D. 10214 deposited in the Head Office, Marine Department, at Wellington, and thereon bordered red.

PURSUANT to section 439 of the Maori Affairs Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby sets apart the Maori freehold land described in the Schedule hereto as a Maori reservation for the purposes of a meeting place, recreation ground, sports ground, and church site for the common use of the Maori people and their descendants.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the Auckland City Council proceeded by way of special order to raise a loan of £700,000 known as the "Works Loan 1957" (hereinafter called "the said loan"):
And whereas the proceedings in connection with the said loan were irregular or defective in that there was an interval of less than fourteen days between the two notifications required by paragraph (c) of section 77 of the Municipal Corporations Act 1954:
And whereas it appears that the ratepayers of the district have not been misled by such irregularity or defect as aforesaid and it is expedient to validate the same:
Now, therefore, pursuant to section 130 of the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the proceedings in connection with the said loan shall be valid to all intents and purposes as though an interval of not less than fourteen days had elapsed between the two notifications, and hereby further orders and declares that the validity of the proceedings in connection with the said loan or of the security for such loan shall not be questioned by reason only of the irregularity or defect aforesaid.
