Declaring Land Acquired for a Government Work and Not Required for That Purpose to be Crown Land Subject as to Parts to Certain Rights

PURSUANT to section 35 of the Public Works Act 1928, the Minister of Works hereby declares the land described in the Schedule hereto to be deemed to have been Crown land for the purposes of the Land Act 1948 as from the 7th day of November 1956, subject as to Lots 8 to 19 and 36 to 50 (all inclusive), D.P. 44206, to Proclamation No. 12806 defining the middle line of a motorway, and subject as to Lots 1 to 5, 60 to 65, 70 to 75, 82 to 95, 120 to 125, 153, and 155 (all inclusive), D.P. 44205, and Lots 6 to 11, 18, 19, 36 to 42, 49 to 51, and 53 (all inclusive), D.P. 44206, to the building-line restriction contained in K. 58640, Auckland Land Registry.

SCHEDULE

ALL that piece of land in the North Auckland Land District containing 16 acres and 6·8 perches, situated in the Borough of Mount Wellington, Auckland R.D., and being Lots 1 to 5, 60 to 65, 70 to 75, 82 to 95, 120 to 125, 153, and 155 (all inclusive), D.P. 44205, and Lots 6 to 19, 36 to 51, and 53 (all inclusive), D.P. 44206. All certificate of title, Volume 1373, folio 15, and part certificate of title, Volume 1373, folio 16, Auckland Land Registry.

Approval of Testing Officer Under the Motor Drivers Regulations 1940

PURSUANT to regulation 5 of the Motor Drivers Regulations 1940, the Minister of Transport hereby approves of the person named in column 2 of the Schedule hereunder being a testing officer under the said regulations for the authority specified in column 1 of the said Schedule.

Exemption Order Under the Motor Drivers Regulations 1940

PURSUANT to the Motor Drivers Regulations 1940, the Minister of Transport hereby orders and declares that the provisions of clause (1) of regulation 7 of the said regulations so far as they relate to the driving of heavy trade motors shall not apply to the persons hereinafter mentioned, but in lieu thereof the following provision shall apply:

A motor driver's licence issued under the Motor Drivers Regulations 1940 to the persons described in Column 1 of the Schedule hereunder may authorise them to drive a heavy trade motor in the course of their employment for the employers described in column 2 of the said Schedule, but shall not authorise them, while they are under the age of eighteen years, to drive a heavy trade motor for any other purpose.

Licensing Winstone Ltd. to Use and Occupy a Part of the Bed of the Waikato River at Mercer as a Site for a Revetment

PURSUANT to the Harbours Act 1950, the Minister of Marine hereby licenses and permits Winstone Ltd. (hereinafter called the licensee, which term shall include its successors or assigns, unless the context requires a different construction) to use and occupy a part of the bed of the Waikato River at Mercer, as shown on plan marked M.D. 10127 and deposited in the office of the Marine Department at Wellington, for the purposes of erecting and maintaining thereon a revetment as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

  1. This licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

  2. The term of the licence shall be fourteen years from the lst day of June 1957.

  3. The premium payable by the licensee shall be five pounds (£5) and the annual sum so payable ten pounds (£10).

Licensing the Vincent County Council to Use and Occupy Part of the Foreshore at Makarora in Lake Wanaka as a Site for a Wharf

PURSUANT to the Harbours Act 1950, the Minister of Marine hereby licenses and permits the Vincent County Council (hereinafter called the Council, which term shall include its successors or assigns, unless the context requires a different construction) to use and occupy a part of the foreshore and land below low-water mark at Makarora, in Lake Wanaka, as shown on plan marked M.D. 8211 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a wharf as shown on the said plan, such licence to be held and enjoyed by the Council upon and subject to the terms and conditions set forth in the Schedule hereto.
