Directing Sale of Railway Land at Pigeon Bush Under the Public Works Act 1928

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby directs the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was acquired.
SCHEDULE APPROXIMATE areas of the pieces of land directed to be sold: A. R. P. Being 2 0 33·6 Part railway land in Memorial of Proclamation 29355, being part Section 2, Western Lake Block; coloured sepia. 0 2 16·7 Part railway land in conveyance 37993, being part Rural Sections 201 and 203, Township of Featherston; coloured blue. Both situated in Block VI, Wairarapa Survey District. 12 0 38·8 Part railway land in Memorial of Proclamation 29355, being part Rural Sections 178, 181, 184, 187, 190, 192, 195, 197, 199, 201, 203, and 204, Township of Featherston; coloured orange. Situated in Blocks II and VI, Wairarapa Survey District. All situated in Featherston County. (S.O. 23745.)
In the Wellington Land District; as the same are more particularly delineated on the plan marked L.O. 14684 deposited in the office of the Minister of Railways at Wellington, and thereon coloured as above mentioned.

SCHEDULE APPROXIMATE area of the piece of land directed to be sold: 1 acre 2 roods 2·7 perches. Railway land, being part Section 1, Pakuratahi District. Situated in Block XV, Akatarawa Survey District, Hutt County. (S.O. 23658.) In the Wellington Land District; as the same is more particularly delineated on the plan marked L.O. 14716 deposited in the office of the Minister of Railways at Wellington, and thereon coloured orange.

Authorising Herbert John McCaa, of Tutaki, Farmer, to Use Water for the Purpose of Generating Electricity

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Herbert John McCaa, of Tutaki, farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from the Te Peita Creek (hereinafter referred to as the said stream) situated in Section 7, Block IV, Tutaki Survey District, in the County of Murchison, for the purpose hereinafter set forth, a stream of water not exceeding 5 cubic feet per second at any one time.
CONDITIONS IMPLIED CONDITIONS 1. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS 2. This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
UTILISATION OF WATER AND LOCATION OF HEADWORKS 3. Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at the point in Section 7, Block IV, Tutaki Survey District, indicated on the plan marked P.W.D. 92067 deposited in the office of the State Hydro-electric Department at Wellington.
GENERAL DESCRIPTION OF WORKS 4. The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan P.W.D. 92067: (a) Headworks consisting of a dam and intake with a water race leading to the powerhouse hereinafter referred to, giving a static head of approximately 17 ft. (b) Pelton wheel and powerhouse with all necessary equipment for generating electricity, situated in Section 7, Block IV, Tutaki Survey District. (c) Tail race leading from the said powerhouse to the Mangles River.
SYSTEM OF SUPPLY 5. The system of supply shall be as described in paragraph (d) of regulation 21-01 of the Electrical Supply Regulations 1935, and shall be an alternating-current system.
DURATION OF LICENCE 6. Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1978.
RENTAL 7. For the purpose of assessing the rental or annual sum payable in respect of this licence, the maximum generating capacity of the plant at the commencement of this licence is 5 kilowatts.
NO RIGHT TO WATER CONFERRED 8. Nothing in this licence shall of itself confer upon the licensee any right to water.
