IN VOLUNTARY LIQUIDATION

Notice of Meeting of Creditors
Pursuant to sections 284 and 362 (8) of the Companies Act 1955, notice is hereby given that, at a meeting of Modern Softgoods Ltd. (under receivership) held on 28 March 1957, the following resolution was passed as an extraordinary resolution:

“1. That the company cannot by reason of its liabilities continue in business, and that it is advisable to wind up, and that the company be wound up voluntarily.

“2. That Robert James Cook, public accountant, of Dunedin, be and is hereby appointed liquidator of the company.

“3. That steps be taken to call a meeting of creditors within the statutory period.”

Notice is therefore given that a meeting of the creditors of the said company will be held, pursuant to sections 284 and 362 (8) of the Companies Act 1955, at the Chamber of Commerce Boardroom, Dowling Street, Dunedin, on Monday, 8 April 1957, at 11 o'clock in the forenoon, at which meeting a full statement of the position of the company's affairs together with a list of the creditors and the estimated amount of their claims will be laid before the meeting, and at which meeting the creditors, in pursuance of section 285 of the Act, may nominate a person to be the liquidator of the company, and in pursuance of section 286 of the said Act, may appoint a committee of inspection.

Notice is hereby given that a petition for an order that John Eftimopol, Wellington, be ordered to purchase (in the names of himself and/or his nominees) all those 500 shares of the petitioner, Melanie Margaret Vamos, of Wellington, manufacturer, in the above-named company for the sum of £500 and that pending completion of the sale of the said shares;

(a) Norman Henry Russell, of Wellington, public accountant, be appointed a director of the company in addition to the existing directors John Eftimopol and Melanie Margaret Vamos, the said Norman Henry Russell to be chairman of Directors and to be entitled to be paid his reasonable charges and expenses for so doing.

(b) No change be made in the directors of the company without the leave of the Court.

(c) The company’s bank account be operated only on the signatures of any two of the directors, but that any one director have power to endorse cheques, promissory notes, or bills of exchange on behalf of the company, or for such other order as shall be just; and in the alternative for the winding up of the above-named company by the Supreme Court was, on the 28th day of March 1957, presented to the said Court by Melanie Margaret Vamos, of Wellington, manufacturer; and that the said petition is directed to be heard before the Court sitting at Wellington on the 17th day of April 1957 at 10 o’clock in the forenoon; and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of hearing in person or by his counsel for that purpose, and a copy of the petition will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.

PUBLIC notice is hereby given that the Hamilton City Council proposes to execute certain public works, to wit, the widening of a street for which purpose the lands described in the Schedule hereto require to be taken by the Hamilton City Council under the provisions of the Public Works Act 1928, sections 22 and 23; a plan of the lands required to be taken as aforesaid is open for inspection at the office of the Hamilton City Council, Alma Street, Hamilton.
All persons affected are hereby called upon to set forth in writing any well founded objections to the execution of such works or to the taking of such lands and to send such writing to the Hamilton City Council within forty days from the date of the first publication of this notice.

HOROWHENUA ELECTRIC POWER BOARD
RESOLUTION MAKING SPECIAL RATE
Electric Reticulation Loan No. 11, 1956, £50,000

In pursuance and exercise of the powers vested in it in that behalf by the Local Bodies’ Loans Act 1926 and of all other powers (if any) it thereunto enabling, the Horowhenua Electric Power Board hereby resolves as follows:

“That, for the purpose of providing for the payment of principal, interest, and other charges on the Horowhenua Electric Power Board Electric Reticulation Loan No. 11, 1956, of £50,000, authorised to be raised by the Horowhenua Electric Power Board under the above-mentioned Act for the purpose of further extending reticulation in the Board’s district, the said Board hereby makes and levies a special rate of 1/25th of a penny in the pound on the rateable value (on the basis of the capital value) of all rateable property in the Horowhenua Electric Power Board District, as defined in the Proclamation appearing in the Gazette, No. 100, of the 1st day of December 1921; and that such special rate shall be an annually recurring rate during the currency of such loan and be payable on the 1st day of April in each and every year during the currency of the loan, being a period of twenty years, or until the loan is fully paid off.”
