PURSUANT to the Fire Services Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares the Mount Maunganui Secondary Urban Fire District to be an urban fire district by the name of the Mount Maunganui Urban Fire District.

Disposition of Assets and Liabilities of Former County of Kawhia and Former Kawhia Harbour Board

ORDER IN COUNCIL

At the Government House at Wellington this 27th day of March 1957

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by an Order in Council made on the 23rd day of March 1956 and published in the Gazette of the same date at page 421 the County of Kawhia was abolished and portion thereof was included in the County of Otorohanga and the remainder in the County of Waitomo and the Kawhia Harbour Board was dissolved:

Now, therefore, pursuant to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares:

  1. That the Councils of the Counties of Otorohanga and Waitomo may, by agreements executed under the common seals of their respective Corporations, make, between those Counties such an adjustment of property, liabilities, contracts, and engagements, and all rights and authorities of any nature whatever, of the former County of Kawhia and the former Kawhia Harbour Board, as those Councils think fit, and every such agreement shall be enforceable accordingly.

  2. Any agreements made pursuant to paragraph 1 hereof shall provide, inter alia, for the following matters:

    (a) What part of the real and personal property of the former County of Kawhia and the former Kawhia Harbour Board shall become the property of the Corporations of the Counties of Otorohanga and Waitomo respectively.

    (b) What part of any rates payable to the former Kawhia County Council shall be deemed payable to the Otorohanga and Waitomo County Councils respectively.

    (c) What part of the debts, liabilities, or engagements of the former County of Kawhia and the former Kawhia Harbour Board whether absolute or outstanding at the 31st day of March 1956 or then contingent or prospective (if the same be capable of estimation) shall be liabilities or engagements of the Corporations of the Counties of Otorohanga and Waitomo respectively.

    (d) What part of the interest and sinking fund of any loans raised by the former Kawhia County Council shall be payable by the Otorohanga and Waitomo County Councils respectively.

PURSUANT to the Fire Services Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares the urban area of Darfield in the County of Malvern, and the Town District of Nightcaps, to be secondary urban fire districts by the names of the Darfield Secondary Urban Fire District and the Nightcaps Secondary Urban Fire District, respectively.

PURSUANT to section 18 of the Fire Services Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares the urban area of Tolaga Bay, situated in the County of Uawa, to be a secondary urban fire district by the name of the Tolaga Bay Secondary Urban Fire District.

Boundaries of the Hauraki United Drainage District Altered

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares:

  1. That, as and on from the 1st day of April 1957, the area described in the First Schedule hereto shall be included in the Hauraki United Drainage District.

  2. That the boundaries of the Hauraki United Drainage District as so altered shall be those set out in the Second Schedule hereto.

  3. That the alteration of boundaries of the said district hereinbefore made shall be deemed to have been effected under the Soil Conservation and Rivers Control Act 1941 and the Land Drainage Act 1908.

FIRST SCHEDULE

AREA INCLUDED IN HAURAKI UNITED DRAINAGE DISTRICT

All that area of approximately 2,200 acres in Blocks VIII and XI, Thames Survey District, bounded by a line commencing at a point on the line of mean high water of the Firth of Thames, in line with the south-western boundary of Section 1s, Orongo Settlement, and running north-easterly and south-easterly along the aforesaid line of mean high water and the line of mean high water of the left bank Waihou River to a point in line with the southern boundary of Section 50s of the aforesaid settlement; thence westerly generally along a right line to and along the southern boundary of the aforesaid Section 50s and the southern boundaries of Sections 51s and 34s, crossing the intervening Orongo-Netherton Main Highway to the southern corner of the last-mentioned section; thence north-westerly along the south-western boundary of the aforesaid Section 34s, the south-western boundaries of Sections 33s, 27s, 17s, 43s, 49s, 48s, 41s, 3s, and 1s crossing the intervening Pipiroa-Kopu Main Highway and all the aforesaid sections being of Orongo Settlement, and along a right line being the south-western boundary of the aforesaid Section 1s produced to the line of mean high water of the Firth of Thames, being the point of commencement.

SECOND SCHEDULE

BOUNDARIES OF HAURAKI UNITED DRAINAGE DISTRICT

All that area in the County of Hauraki Plains in the South Auckland Land District bounded by a line commencing at the junction of the right bank of the Piako River and the shores of the Firth of Thames in Block VII, Thames Survey District, and running generally north-easterly along those shores to and generally southerly along the left bank of the Waihou River to a point in Block VII, Waihou Survey District, in line with the northern boundary of Lot 3, D.P. 8682, being parts Te Arawhakapekapeka Nos. 2B and 2C Blocks; thence westerly generally along a right line to and along that boundary, crossing the intervening Pokeno-Paeroa via Ngatea State Highway along the western boundary of the said Lot 3, and along the northern boundary of the part Te Arawhakapekapeka No. 2A Block shown on D.P. 5011, to and along the northern and western boundaries of Lot 1, D.P. 33630, being part Kaikahu.
