Boundaries of Borough of Whangarei and County of Whangarei Altered and Borough of Whangarei and Town District of Onerahi United

At the Government House at Wellington this 27th day of February 1957
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 35 of the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares:

That, as on and from the 1st day of April 1957, the area described in the Schedule hereto shall be excluded from the County of Whangarei and included in the Borough of Whangarei.

(a) That, upon the inclusion in the Borough of Whangarei of the area described in the Schedule hereto, the Borough of Whangarei and the Town District of Onerahi shall as on and from the date aforesaid, be constituted a united borough by the name of the Borough of Whangarei.
(b) That the united Borough of Whangarei shall be an undivided borough and that the number of councillors to be elected at the first triennial election of councillors after the date aforesaid shall be nine, exclusive of the Mayor.
(c) That Reginald Charles Major, the Town Clerk of the existing Borough of Whangarei, shall be the Town Clerk and Returning Officer of the united Borough of Whangarei. -
That the said alteration of boundaries and the said union hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.
SCHEDULE
AREA EXCLUDED FROM THE COUNTY OF WHANGAREI AND INCLUDED IN THE BOROUGH OF WHANGAREI
All that area of approximately 878 acres in the North Auckland Land District, bounded by a line commencing at a point on the eastern boundary of the Borough of Whangarei, being the eastern corner of Lot 1, D.P. 39953, being part Allotment 1, Parahaki Parish, in Block IX, Whangarei Survey District, and running easterly generally along the south-western and south-eastern boundaries of part Allotment 2, Parahaki Parish, shown on D.P. 17205, to and along the south-western boundary of another part of the aforesaid Allotment 2, shown on D.P. 19998, along a right line, being that boundary produced to the middle of the Old Heads Road, and along the middle of that road to a point in line with the western boundary of Lot 12, D.P. 18256, being part Allotment 4 of the aforesaid parish; thence along a right line to and along the western and south-western boundaries of the said Lot 12, along the northern and eastern boundaries of Section 30, Block IX aforesaid, to and along the southern boundary of Lot 26, D.P. 18256, being part Allotment 5 of the said parish, to and along the south-western boundaries of Lots 2 and 4, D.P. 27781, being parts of Allotments 5, 6, and 114 of the said parish, along a right line, being the last-mentioned boundary produced to the middle of Mackesy Road, and along the middle of that road to and along the middle of Rata Road, to and along the southern end of that road, along the western boundary generally of Lot 75, D.P. 18256, being part of Allotment 6 aforesaid, and along a right line, being the last-mentioned boundary produced to the middle of the old Whangarei-Onerahi Highway; thence along the middle of that highway to and along the middle of the public road forming the northern boundary of Section 32, Block IX aforesaid, to a point in line with the generally northern boundary of part Te Wharauroa No. 1 Block, being the land comprised and described in certificate of title, Volume 1038, folio 300, and along a right line to and along the northern, eastern, and southern boundaries of the aforesaid part No. 1 Block, to and along a series of right lines parallel to and 250 links distant from the north-eastern side of the new Whangarei-Onerahi Main Highway as shown on S.O. Plan 35933, to the left bank of the Waimahanga Stream; thence down the said bank to and along the north-eastern side of the new highway aforesaid, to and south-westerly along the boundary of the Onerahi Town District as described in Gazette, No. 81, of the 6th day of November 1913, page 3351, to the south-western side of the aforesaid highway; thence westerly generally along that south-western side, to and down the left bank of the Waimahanga Stream aforementioned, to and along the south-eastern and western boundaries generally of Section 24, Block IX aforesaid, to the angle in the western boundary of that section near the mouth of the Waimahanga Stream at low water; thence along a right line to a point in the middle of the Whangarei River channel at low water, opposite the mouth of the Awaroa Stream channel at low water, and again westerly generally up the middle of the low-water channel of the Whangarei River to a point bearing 38° 36' 30" from the middle of a bridge on the Port Whangarei Road crossing the Haha or Limeburners Creek; thence along a right line between that last-mentioned point in the middle of the Whangarei River and the middle of the bridge aforesaid, to the north-eastern side of the Port Whangarei Road aforementioned, being a point on the boundary of the Borough of Whangarei aforesaid; thence northerly generally along the boundaries of that borough as described in Gazette, No. 45, of the 7th day of June 1951, page 819, to the point of commencement.

PURSUANT to section 3 of the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and on the recommendation of the Minister of Internal Affairs, hereby appoints
Archibald Albany McLaclan, Esquire, Stipendiary Magistrate, of Lower Hutt,
to be a member and to be the Chairman of the Local Government Commission for a term of three years commencing on the 1st day of April 1957.

PURSUANT to the Local Government Loans Board Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the Pukekohe Borough Council is proceeding by way of special order to raise loans of £7,000 and £12,000 to be known respectively as Pensioners’ Flats Loan 1956 and Streets Improvements Loan 1956 (hereinafter called the said respective loans):
And whereas the proceedings in connection with the said respective loans have been irregular or defective in that the two notifications in respect of the raising of the said respective loans, as required by paragraph (c) of section 77 of the Municipal Corporations Act 1954, although given twice with an interval of not less than fourteen days between each, were not given during the period of twenty-eight days immediately preceding the date of the subsequent meeting confirming the resolutions to raise the said respective loans:
And whereas it appears that the ratepayers of the district have not been misled by such irregularity or defect as aforesaid and it is expedient to validate the same:
Now, therefore, pursuant to section 122 of the Local Bodies' Loans Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council
