Declaring Land Vested in the Crown to be Free from Samoan Title

A PROCLAMATION

WHEREAS it is enacted by section 282 of the Samoa Act 1921 that a Proclamation by the Governor-General that any land vested in the Crown is free from Samoan title shall in all Courts and in all proceedings be accepted as conclusive proof of the fact so proclaimed, and whereas the land described in the Schedule hereto is land vested in Her Majesty in right of the Government of Western Samoa by virtue of a conveyance dated the 25th day of August 1955 from the Alii and Faipule of Saleloga, now, therefore, pursuant to section 282 of the Samoa Act 1921, I, Sir Harold Eric Barrowclough, the Administrator of the Government of New Zealand, hereby proclaim that the said land is free from Samoan title.

SCHEDULE

ALL that piece or parcel of land containing an area of 2 roods 8 perches, more or less, situated at Saleloga, in the District of Faasaleleaga, and described as Parcel 99, Flur I, Savaii, as the same is more particularly delineated on plan 65S/1S deposited at the office of the Chief Surveyor at Apia.

Given under the hand of His Excellency the Administrator of the Government, and issued under the Seal of New Zealand, this 15th day of June 1956.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises Albert Colin Goudie, of Colville, Farmer (hereinafter referred to as the licensee), subject to the conditions hereafter set forth, to lay, construct, put up, place, and use the electric lines described in the Schedule hereto.

CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with all regulations hereafter made in amendment thereof or in substitution therefor respectively.

SYSTEM OF SUPPLY

  1. The system of supply shall be as described in paragraph (d) of regulation 21-01 of the Electrical Supply Regulations 1935, and shall be an alternating-current system.

DURATION OF LICENCE

  1. Unless sooner lawfully determined, this licence shall continue in force until the 31st day of March 1977, or until electrical energy is available from an electric power board or some other public source of supply whichever is the earlier.

SCHEDULE

LINES for the supply of electrical energy by the system of supply hereinbefore described, commencing from the licensee’s generator situated in part Section 26, Umangawha Block, Block V, Harataunga Survey District, in the County of Coromandel, and proceeding in a northerly direction to the licensee’s residence situated in the said Section 26, Umangawha Block, and thence in a north-easterly direction across the Colville-Coromandel Main Road to the road boundary, and thence in a north-westerly direction along the road boundary to the Colville Public Hall situated in Lot 5, Paraoraki Block, Block V, Harataunga Survey District, the said lines being more particularly shown by means of red lines on the plan marked S.H.D. 401 deposited in the office of the State Hydro-electric Department at Wellington.

Revoking a Licence, Authorising David Goodwin, of Waimamaku, Farmer, to Use Water for the Purpose of Generating Electricity and to Erect Certain Electric Lines

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and with the consent of the licensee, hereby revokes the Order in Council dated the 1st day of November 1939 and published in the Gazette on the 9th day of the same month at page 3033, authorising Bennett Goodwin, of Waimamaku, Farmer, to use water for the purpose of generating electricity and to erect certain electric lines, the rights, powers, and privileges under the said Order in Council having been assigned to David Goodwin, of Waimamaku, Farmer.

SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken: 6·06 perches.

Being part Section 207, Taratahi Plain Block, coloured blue. Situated in Block X, Tiffin Survey District, Borough of Carterton. (S.O. 21627.)

In the Wellington Land District; as the same is more particularly delineated on the plan marked P.W.D. 129583 deposited in the office of the Minister of Works at Wellington, and thereon coloured as above mentioned.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Auckland City Council on the 25th day of April 1956, and set out in the First Schedule hereto, in so far as it affects the side and portion of the street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the area of 0·2 perch, being Lot 3 of a subdivision of Lot 40, Deeds Plan No. 473, shown on the plan marked P.W.D. 150680 referred to in the said Second Schedule.

FIRST SCHEDULE

THE Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the western side of Edinburgh Street fronting Lots 1, 2, and 3 of part Lots 40, 41, 42, and 43 on Deeds Plan 473, being part of Allotment 10, Section 7, Suburbs of Auckland, and being all the land comprised in certificate of title, Volume 520, folio 151, Auckland Registry.

SECOND SCHEDULE

THE western side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Edinburgh Street, fronting Lots 40 and 43, Deeds Plan No. 473, being part Allotment 10, Section 7, Suburbs of Auckland.

As the same is more particularly delineated on the plan marked P.W.D. 150680 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
