Town and Country Planning Act 1953—County of Bay of Islands
PUBLIC notice is hereby given that pursuant to section
20 (1) of the Town and Country Planning Act 1953,
approval has been granted to the Bay of Islands County
Council to prepare, recommend, and approve its district
scheme by four sections as follows:

  1. Kerikeri section described in the First Schedule hereto.
  2. Paihia section described in the Second Schedule hereto.
  3. Moerewa section described in the Third Schedule hereto.
  4. Country section, being the remainder of the county.
    FIRST SCHEDULE
    BAY OF ISLANDS COUNTY DISTRICT SCHEME (KERIKERI SECTION)
    ALL that area in Block XI, Kerikeri Survey District, bounded
    by a line commencing at a point on the right bank of the
    Kerikeri River, being the western corner of Lot 1, D.P.
    33905, being part of Old Land Claim No. 39, and running
    south-easterly generally along the south-western boundary
    of the aforesaid Lot 1, to and north-easterly along the
    north-western side of the Springbank-Kerikeri Main Highway
    to its intersection with a right line on the northern side of,
    parallel to, and 100 links distant from, the northern boundary
    of Lot 6, D.P. 21496, being part of the aforesaid Old
    Land Claim No. 39; thence along the aforesaid right line
    across the intersection of the aforesaid highway with the
    northern end of Hone Heke Road, to and southerly generally
    along the eastern side of the aforesaid road, to the western
    corner of Lot 2, D.P. 36697, being part of Old Land Claims
    Nos. 3 and 39; thence along the southern boundary generally
    of Lot 2 aforesaid to and up the left bank of the Wairoa
    Stream to the north-eastern boundary of Lot 2, D.P. 34108,
    being part of Old Land Claim No. 3; thence north-westerly
    generally along the aforesaid north-eastern boundary, along
    a right line to and along the north-eastern boundary of
    Lot 1, D.P. 25252, and the north-eastern boundary of Lot 16,
    D.P. 24892, both lots being parts of the aforesaid Old Land
    Claim No. 3, to and along the south-eastern side of the
    Springbank-Kerikeri Main Highway aforesaid to a point in
    line with the north-eastern boundary of Lot 38, D.P. 21955,
    being part of the aforesaid Old Land Claim No. 3; thence
    along a right line across the aforesaid main highway to and
    along the north-eastern boundary of the said Lot 38 to the
    right bank of the Puketotara River; thence down that right
    bank and the right bank of the Kerikeri River aforementioned
    to the western corner of Lot 1, D.P. 33905
    aforesaid, the point of commencement.
    SECOND SCHEDULE
    BAY OF ISLANDS COUNTY DISTRICT SCHEME (PAHIA SECTION)
    ALL that area in Blocks IV and VIII, Kawakawa Survey
    District, bounded by a line commencing at Ti Point on the
    southern head at the mouth of the Waitangi River and running
    south-easterly generally along the line of mean high
    water of the Bay of Islands and the Veronica Channel to the
    north-eastern corner of Lot 17, D.P. 11101, being part of
    Old Land Claim No. 251; thence westerly generally along the
    northern boundary of the aforesaid Lot 17 to and along the
    line of mean high water along the northern shore of the
    Haumi River, to and along the south-western boundary of
    Section 12, Block VIII, Kawakawa Survey District, and
    again along the aforesaid line of mean high water to the
    southern boundary of Section 5 of the aforesaid Block VIII;
    thence easterly, northerly, and westerly generally along the
    generally eastern and northern boundaries of the aforesaid
    Section 5 to the south-eastern corner of Section 7, Block IV,
    Kawakawa Survey District; thence northerly generally along
    the eastern and northern boundaries of the aforesaid Section
    7 to and along the eastern boundaries of Te Ti Nos. 7 and 6
    Blocks to the Paihia-Blackbridge Main Highway; thence
    southerly along a right line bearing 196° 32’ to a point in
    line with the north-western boundary of the part Te Ti No. 12
    Block containing an area of 2 roods and 0·4 perch, and
    shown on M.L. Plan 13485, and along another right line to
    and along that north-western boundary, and the production
    of that boundary to the Paihia-Blackbridge Main Highway
    aforementioned; thence along a right line crossing that main
    highway at right angles, to and south-westerly along the
    north-western side of the said highway to and north-westerly
    along the north-eastern boundary of Te Ti No. 5 Block,
    to the eastern side of the Tahuna Pipi Road line; thence
    along a right line running due west to and along the line
    of mean high water along the southern shores of the Waitangi
    River to Ti Point, the point of commencement.
    THIRD SCHEDULE
    BAY OF ISLANDS COUNTY DISTRICT SCHEME (MOEREWА
    SECTION)
    ALL that area in Block XV, Kawakawa Survey District,
    bounded by a line commencing at a point in the middle of
    the Otiria Stream, in line with the eastern boundary of
    Motatau No. 4H 6A Block, and running generally north-
    easterly down the middle of that stream to the intersection
    with a right line on the north-eastern side of, parallel to,
    and 500 links distant from, the north-eastern boundary of
    Lot 2, D.P. 25762, being part Waipuna Block; thence southeasterly
    along that right line to the middle of the Waiharakeke
    River; thence generally south-westerly and westerly up the
    middle of that river to a point in line with the north-eastern
    boundary of Motatau No. 4H 5 Block; thence generally
    north-westerly along a right line to and along that north-eastern
    boundary, and along the northern boundaries of the
    said No. 4H 5 Block, and of Motatau No. 4H 3 Block, to a
    point in line with the eastern boundary of Motatau No.
    4H 6A Block aforementioned; thence along a right line to
    and along that boundary, and along that boundary produced,
    to the middle of the Otiria Stream, the point of
    commencement.

    Exemption Order Under the Motor Drivers Regulations 1940
    PURSUANT to the Motor Drivers Regulations 1940, the
    Minister of Transport hereby orders and declares that
    the provisions of clause (1) of regulation 7 of the said regulations
    so far as they relate to the driving of heavy trade
    motors shall not apply to the person hereinafter mentioned,
    but in lieu thereof the following provision shall apply:
    A motor driver’s licence issued under the Motor Drivers
    Regulations 1940, to the person described in column 1 of the
    Schedule hereunder may authorise him to drive a heavy
    trade motor in the course of his employment for the employer
    described in column 2 of the said Schedule, but shall not
    authorise him, while he is under the age of eighteen years,
    to drive a heavy trade motor for any other purpose.

    Approval of Motor-cycle Safety Helmets in Terms of Traffic
    Regulations 1936
    PURSUANT to clause (9) of regulation 16 of the Traffic
    Regulations 1936 as inserted by regulation 5 of the
    Traffic Regulations 1936, Amendment No. 15, the Minister
    of Transport hereby approves for the purposes of the said
    regulation of the motor-cycle safety helmets of the make
    and type described in the Schedule hereto.
    SCHEDULE
    SAFETY helmets manufactured by Firma Polymer, Neuauibling,
    Germany, and marked “Safeguard”.

    Consent to Erection of Flashing Red Traffic Control Lights
    by the Air Department
    PURSUANT to clause (6E) of regulation 4 of the Traffic
    Regulations 1936 (as inserted by the Traffic Regulations
    1936, Amendment No. 8), the Minister of Transport hereby
    consents to the erection of flashing red lights by the Air
    Department at the two places described in the Schedule
    hereto for the purposes of traffic control in terms of clause
    (6D) of the said regulation 4.
    SCHEDULE
    SITUATED within the Manawatu County-
    On Pukenui Road adjacent to the Ohakea Royal New
    Zealand Air Force Station at the two points opposite the
    number 1533 aircraft runway more particularly indicated on
    Plan TT 1424 deposited in the office of the Commissioner
    of Transport at Wellington.
