At the Government House at Wellington this 16th day of November 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Wellington City Council on the 10th day of August 1955, and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto.

FIRST SCHEDULE

THE Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the northern side of the portion of Wade Street West, adjoining part Section 3, Kaiwharawhara District, being all of the land in certificate of title, Volume 132, folio 263, Wellington Registry.

SECOND SCHEDULE

THE northern side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Wade Street West, fronting part Section 3, Kaiwharawhara District, Wellington Land District. As the same is more particularly delineated on the plan marked P.W.D. 148518 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Varying a Condition as to Setting Back the Building Line of Portion of a Street in the Borough of Papatoetoe, Imposed by Order in Council, Under Section 125 of the Public Works Act 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 27 of the Public Works Amendment Act 1948, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 10th day of May 1955, published in Gazette, 12 May 1955, Vol. II, page 767, and deposited in the Land Registry Office at Auckland as No. 14517, authorizing the laying off of the street described in the Schedule of the said Order in Council subject to a condition as to the building line, by varying the condition with regard to the building line imposed by the said Order in Council so that no building or part of a building shall at any time be erected on Lot 17, D.P. 42664, within a distance of 33 ft. from the centre line of the said street.

Consenting to Stopping Road in Block IV, Drury Survey District, Franklin County

PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Franklin County Council stopping the portion of road described in the Schedule hereto.

SCHEDULE

APPROXIMATE area of the piece of road permitted to be stopped: 2 roods 16 perches.

Adjoining Allotments 56, 57, 58, 59, 60, 61, 69, 70, 71, 72, 73, and 74, Section 8, Village of Drury.

Situated in Block IV, Drury Survey District, Auckland R.D. (S.O. 38897.)

In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 148551 deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

APPROXIMATE area of the piece of land permitted to be taken: 2 roods 29·9 perches.

Being part Section 1, and being part of the land comprised and described in certificate of title, Volume 18, folio 128, Marlborough Land Registry.

Situated in Block XVIII, Hundalee Survey District, Marlborough R.D. (S.O. 4090.)
