Amending an Order in Council Authorizing the Taihape Borough Council to Use Water for the Purpose of Generating Electricity and to Erect and Use Electric Lines

At the Government House at Wellington this 2nd day of November 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 3rd day of August 1953 and published in the Gazette on the 13th day of the same month, at page 1309, authorizing the Taihape Borough Council to use water for the purpose of generating electricity, and to erect and use electric lines, by revoking the said Order in Council in so far as it operates as a licence to use water for the purpose of generating electricity but not in so far as it operates as a licence to lay, construct, put up, place, and use electric lines.

ORDER IN COUNCIL

At the Government House at Wellington this 2nd day of November 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Rabbits Act 1955, His Excellency the Governor-General, at the request of the Minister of Agriculture made on the recommendation of the Rabbit Destruction Council, and acting by and with the advice and consent of the Executive Council, hereby constitutes and declares the area of land, the boundaries of which are described in the Schedule hereto, being an area to which subsection (1) of section 14 of the Rabbits Act 1955 applies, a rabbit district and appoints that the name of the said rabbit district shall be the Waipahi Rabbit District, and orders that the basis on which the Rabbit Board to be established for the said district shall first levy its general rate shall be the acreage of land occupied by the ratepayer.

SCHEDULE

BOUNDARIES OF THE WAIPAHl RABBIT DISTRICT

ALL that area in the Otago Land District and the County of Clutha containing 45,000 acres, more or less, bounded by a line commencing at the confluence of the Waipahi River with the Pomahaka River; thence generally north-easterly and south-easterly along the right bank of the Pomahaka River to a point in line with the southern boundary of Lot 56, Deposited Plan 1963; thence generally south-westerly to and along that boundary and the southern boundary of Lot 55, Deposited Plan 1963; the south-eastern boundaries of Sections 61, Block X, 33 and 32, Block XI, Pomahaka Survey District, to a point in line with the eastern boundary of Section 30; thence southerly to and along the eastern boundary of Section 30, and easterly and southerly along the northern and eastern boundaries of Section 11, Block XI, Pomahaka Survey District, to Old Lake Road; thence generally north-westerly along Old Lake Road to a point in line with the eastern boundary of Section 41, Block III, Waipahi Survey District; thence southerly to and along that boundary and its production across a road to the southern boundary of Section 20; thence westerly along the southern boundary of Section 20 to a point in line with the eastern boundary of Section 21; thence southerly across the South Island Main Trunk Railway and along the eastern boundaries of Sections 21 and 17 and their production across a road to the north-eastern boundary of Lot 3, Deposited Plan 1968; thence south-easterly, generally south-westerly, north-westerly, and north-easterly along the north-eastern, south-eastern, south-western, and north-western boundaries of that lot to the south-eastern corner of Lot 1, Deposited Plan 2364; thence generally north-westerly along the south-western boundaries of Lot 1, Deposited Plan 2364, Section 38, Arthurton Settlement, and Section 21, Block XVI, Waipahi Survey District, to the right bank of the Waipahi River; thence generally north-westerly and north-easterly along the right bank of the Waipahi River to its confluence with the Pomahaka River to the point of commencement.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Rabbits Act 1955, His Excellency the Governor-General, at the request of the Minister of Agriculture made on the recommendation of the Rabbit Destruction Council, and acting by and with the advice and consent of the Executive Council, hereby constitutes and declares the area of land, the boundaries of which are described in the Schedule hereto, being an area to which subsection (1) of section 14 of the Rabbits Act 1955 applies, a rabbit district, and appoints that the name of the said rabbit district shall be the Papakaio Rabbit District, and orders that the basis on which the Rabbit Board to be established for the said district shall first levy its general rate shall be the acreage of the land occupied by the ratepayer.

BOUNDARIES OF THE PAPAKAIO RABBIT DISTRICT

ALL that area in the Waitaki County, Otago Land District, containing approximately 96,000 acres, more or less, being parts Awamoko, Papakaio, and Oamaru Survey Districts, bounded as follows: Commencing at the confluence of the Waitaki River and the Awamoko Stream; thence generally south-westerly along the centre of that stream to the Pukeuri-Kurow-Oamaru Main Highway; thence south-easterly along the south-western side of that highway to Boundary Road; thence south-westerly along the north side of that road to Bobbing Creek Road; thence southerly along the western side of Bobbing Creek Road to the Ngapara Railway; thence generally south-easterly along the western side of that railway to Windsor Road; thence north-easterly along the northern side of that road to and across the Waiareka-Ngapara-Duntroon Main Highway; thence generally south-easterly along the north-eastern side of that highway to the western boundary of Block II, Oamaru Survey District; thence generally easterly and north-easterly along the northern side of Charles Street and Ardgowan Homes Road to Eden Road; thence northerly along the western side of that road to and across the road on the south-western boundary of Section 75, Ardgowan Settlement; thence generally south-easterly along the north-eastern side of that road and of the road on the south-western side of Sections 57 and 1 of 56, Block I, Redcastle Road, and the road on the southern side of Sections 22 and 21, Block I, Oamaru Survey District, to the mean high-water mark of the South Pacific Ocean; thence generally north-easterly along the mean high-water mark of that ocean to a point in the centre of the mouth of the Waitaki River; thence generally westerly along the centre of the main stream of that river to the point of commencement.

Declaring the Tinui Rabbit District and the Mataikona Rabbit District to be United to Form the Tinui Rabbit District (Notice No. Ag. 5994)

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Rabbits Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, at the request of the Minister of Agriculture made on the recommendation of the Rabbit Destruction Council, hereby declares the Tinui Rabbit District which was constituted by Order in Council on the 28th day of June 1950, and the Mataikona Rabbit District which was constituted by Order in Council on the 27th day of July 1949, to be united and to form one district having the name of the Tinui Rabbit District on and from the 1st day of April 1956.
