At the Government House at Wellington this 15th day of
June 1955
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency
the Governor-General, acting by and with the advice and
consent of the Executive Council, hereby consents to the land
described in the Schedule hereto being taken for soil-conserva-
tion and river-control purposes.
SCHEDULE
APPROXIMATE area of the piece of land permitted to be taken:
17 acres 2 roods 28Β·5 perches.
Being part Lot 1, D.P. 4048, part Tutoko Block.
Situated in Block I, Waimata Survey District, and Block I,
Turanganui Survey District, Gisborne R.D. (S.O. 4836).
In the Gisborne Land District; as the same is more particu-
larly delineated on the plan marked P.W.D. 146659 deposited
in the office of the Minister of Works at Wellington, and
thereon coloured sepia.

Authorizing the Laying-off of a Street Off Gresham Street in
the City of Dunedin Subject to a Condition as to the
Building Line

At the Government House at Wellington this 15th day of
June 1955
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 186 of the Municipal Corporations
Act 1954 and section 125 of the Public Works Act 1928,
His Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby authorizes
the Dunedin City Council to permit the laying-off of the
proposed street described in the Schedule hereto at a width
for part of its length of less than 66 ft., but not less than
42 ft., subject to the condition that no building or part of a
building shall at any time be erected on the land shown edged
green on the plan marked P.W.D. 146759 referred to in the
said Schedule within a distance of 35 ft. from the centre line
of the said street.
SCHEDULE
THAT proposed street in the Otago Land District, City of
Dunedin, containing by admeasurement 1 rood 8 perches, being
part Lots 14 and 15, D.P. 1857, being part Section 8, Block
III, Andersons Bay District.
As the same is more particularly delineated on the plan
marked P.W.D. 146759 deposited in the office of the Minister
of Works at Wellington, and thereon edged red.

Authorizing the Laying-off of a Street Off Hall Road in the
Borough of Port Chalmers Subject to a Condition as to the
Building Line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 186 of the Municipal Corporations

advice and consent of the Executive Council, hereby authorizes
the Port Chalmers Borough Council to permit the laying-off

Cancelling a Condition as to Setting Back the Building Line
of Portion of Courtenay Street in the City of New Plymouth,
Imposed by Memorandum of Acceptance Under Section 128
of the Public Works Act 1928

At the Government House at Wellington this 15th day of
June 1955
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 27 of the Public Works Amendment
Act 1948, His Excellency the Governor-General, acting by
and with the advice and consent of the Executive Council,
hereby amends the Memorandum of Acceptance, dated 12
December 1952 and registered in the Land Registry Office at
New Plymouth under No. W. 7950, exempting the northern
side of portion of Courtenay Street from the provisions of
section 128 of the Public Works Act 1928 subject to a con-
dition as to the building line, by cancelling the condition as
to the building line imposed by the said Memorandum of
Acceptance in so far as it affects Lots 2 and 7, D.P. 7310,
being part Sections 927, 928, and 929, Town of New Plymouth,
being part of the land comprised and described in certificate
of title, Volume 190, folio 3, Taranaki Land Registry.

At the Government House at Wellington this 15th day of
June 1955
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 27 of the Public Works Amendment
Act 1948, His Excellency the Governor-General, acting
by and with the advice and consent of the Executive Council,
hereby amends the Order in Council dated 9 June 1943 and
published in the Gazette of 17 June 1943, Vol. II, page 678,
and deposited in the Land Registry Office at Dunedin as
No. 5250, exempting the north-western side of portion of
Factory Road, in the Borough of Mosgiel, from the provisions
of section 128 of the Public Works Act 1928, subject to a
condition as to the building line, by cancelling the condition
as to the building line imposed by the said Order in Council.

approves of the resolution passed by the New Plymouth City
Council on the 16th day of August 1954, and set out in the
First Schedule hereto, in so far as it affects the side and
portion of street described in the Second Schedule hereto.
