PURSUANT to section 6 of the Housing Amendment Act 1940, His Excellency the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the access way described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Burgesses of the Borough of Mount Albert, and be under the control and management of the Mount Albert Borough Council.

Authorizing the Laying-off of a Street off Redan Road in the Borough of Kaitaia, Subject to a Condition as to the Building Line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Kaitaia Borough Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 40 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 146668 referred to in the said Schedule within a distance of 48 ft. from the centre line of the said street.

SCHEDULE

THAT proposed street in the North Auckland Land District, Borough of Kaitaia, containing by admeasurement 3 roods 16·7 perches, more or less, being part of the land on D.P. 11562 and being part Old Land Claim No. 7 and part Section 28 of Block V, Takahue Survey District.
