PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby proclaims and declares that the Maori land described in the Schedule hereto is hereby taken for road, and that the said land shall vest in Her Majesty the Queen as from the 27th day of June 1955.

APPROXIMATE area of the piece of land taken: 2 roods 3ยท7 perches.

Being part Wahi Tapu.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Dunedin City Council on the 20th day of December 1954, and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Sim Street (described in the Second Schedule hereto) within a distance of 26 ft. 6 in. from the centre line of the said portion of street.


FIRST SCHEDULE

THE Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the south-eastern side of the portion of Sim Street adjoining Lot 20, Deeds Plan 196, and Lot 2, D.P. 3579, being part Section 9, of Block II, Upper Kaikorai Survey District, and being all of the land in certificates of title, Volume 96, folio 229, and Volume 238, folio 106, Otago Land Registry.


SECOND SCHEDULE

THE south-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Sim Street, fronting Lot 20, Block IV, Deeds Plan 196, and Lot 2, D.P. 3579, being part Section 9, Block II, Upper Kaikorai Survey District.

As the same is more particularly delineated on the plan marked P.W.D. 146090 deposited in the office of the Minister of Works at Wellington, and thereon edged red.

Authorizing the Laying-off of a Street Off Kolmar Road in the Borough of Papatoetoe, Subject to a Condition as to the Building Line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Papatoetoe Borough Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 50 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 146451, referred to in the Schedule hereto, within a distance of 50 ft. from the centre line of the said street.


SCHEDULE

THAT proposed street in the North Auckland Land District, Borough of Papatoetoe, containing by admeasurement 1 road 31 perches, more or less, being part Lot 25, D.P. 3156, being part Allotment 37, Parish of Manurewa.

As the same is more particularly delineated on the plan marked P.W.D. 146451 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section 3 of the Public Works Amendment Act 1948, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares the land described in the Schedule hereto to be a service lane for the purposes of Part I of that Act.
