Now, therefore, pursuant to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares:

  1. (a) That as on and from the 20th day of May 1955, the Borough of Mount Wellington and the Road District of Panmure Township shall be constituted a united borough by the name of the Borough of Mount Wellington:

(b) That the united Borough of Mount Wellington shall be an undivided borough and that the number of councillors to be elected at the first triennial election of councillors after the date aforesaid shall be eight, exclusive of the Mayor:

(c) That Lionel Arthur Young, the Town Clerk of the existing Borough of Mount Wellington, shall be the Town Clerk and Returning Officer, of the united Borough of Mount Wellington:

  1. That two members of the Panmure Township Road Board, to be chosen by that Board, shall, on the date aforesaid, be councillors of the united Borough of Mount Wellington until the councillors elected at the first triennial election of councillors after the date aforesaid come into office:

  2. That as on and from the date aforesaid the area described in the Schedule hereto shall be included in the united Borough of Mount Wellington:

  3. That the said union and the said alteration of boundaries hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

SCHEDULE

AREA INCLUDED IN THE BOROUGH OF MOUNT WELLINGTON

ALL that area known as Panmure Basin, bounded by a line commencing at the southernmost point on the boundary of Panmure Township Road District, as described in New Zealand Gazette, 1883, page 651, and proceeding north-westerly along the south-western boundary of that road district to the boundary of Mount Wellington Borough, as described in New Zealand Gazette, 1954, page 1337; thence westerly, southerly, and easterly generally along the boundary of that borough to the left bank of the Tamaki River; thence north-easterly by right line to the point of commencement.

Pursuant to section 10 of the National Parks Act 1952, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that the lands described in the Schedule hereto shall as from the date hereof be added to and form part of the Abel Tasman National Park, and shall hereafter be managed, administered, and dealt with by the Abel Tasman National Park Board in accordance with the provisions of the said Act.

WHEREAS by an Order in Council dated 31 March 1954 and published in the Gazette, 1 April 1954, Vol. I, page 504, Frederick Horowhenua Melrose Hanson, Esquire, of Wellington, being an officer of the Ministry of Works, was appointed to be the Chairman of the National Roads Board: And whereas the said Frederick Horowhenua Melrose Hanson has resigned from membership of the Board:

Now, therefore, pursuant to section 4 of the National Roads Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby appoints

the Honourable William Stanley Goosman, the Minister of Works,

to be the Chairman of the National Roads Board.

The South-eastern Side of Portion of Holloway Road, in the City of Wellington, Exempted from the Provisions of Section 128 of the Public Works Act 1928, Subject to a Condition as to the Building Line

ORDER IN COUNCIL

At the Government House at Wellington this 18th day of May 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Wellington City Council on the 16th day of February 1955 and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Holloway Road (described in the Second Schedule hereto) within a distance of 25 ft. from the centre line of the said portion of street.

FIRST SCHEDULE

The Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the south-eastern side of the portion of Holloway Road adjoining that part of Section 10, Ohirio Registration District, being all (or part) of the land in certificates of title, Volume 341, folio 283, and Volume 341, folio 295, Wellington Registry.

SECOND SCHEDULE

THE south-eastern side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Holloway Road, fronting parts Section 10, Ohirio District, Town of Wellington. As the same is more particularly delineated on the plan marked P.W.D. 146496 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Constituting an Underground Water Area and an Underground Water Authority in the Borough of Onehunga

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Underground Water Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O R D E R

  1. This order may be cited as the Onehunga Underground Water Authority Order 1955.

  2. On and after the date of the making of this order—

(a) The area for the time being comprising the Borough of Onehunga shall be an underground water area.

(b) The said underground water area shall be known as the Onehunga Underground Water Area.

(c) The Onehunga Borough Council shall be the Underground Water Authority for the Onehunga Underground Water Area.

  1. No by-law shall be made by the said Underground Water Authority under section 8 of the Underground Water Act 1953 at any time within three years after the date of the making of this order unless the said Underground Water Authority has forwarded a copy of the by-law to the Auckland Metropolitan Drainage Board and has allowed that Board a reasonable opportunity to comment thereon.
