Authorizing the Taranaki Harbour Board to Reclaim Land in New Plymouth Harbour

ORDER IN COUNCIL

At the Government House at Wellington this 1st day of December 1954

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS it is provided by section 175 of the Harbours Act 1950 (hereinafter called the said Act) that the Governor-General may from time to time, by Order in Council, authorize any local authority or Harbour Board to reclaim from the sea areas, not exceeding 5 acres in extent, in any case where he considers that the reclamation will not affect navigation, and is for the benefit of the public.

And whereas the Taranaki Harbour Board (hereinafter called the Board) is desirous of reclaiming from the sea certain land at Ngamotu Beach in New Plymouth Harbour, and the said reclamation is of such a nature as aforesaid, and the Board has applied to the Governor-General in Council for an Order authorizing the execution of the said harbour works:

And whereas it has been made to appear to the Governor-General in Council that the proposed work will not be or tend to the injury of navigation, and is for the benefit of the public:

Now, therefore, pursuant to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes and empowers the Board to reclaim from the sea at Ngamotu Beach in New Plymouth Harbour the land edged red on plan marked M.D. 9745 and deposited in the office of the Marine Department at Wellington, such reclamation to be carried out and constructed in accordance with plan marked M.D. 9745, subject to the provisions of the said Act.

PURSUANT to the Naval Defence Act 1913, His Excellency the Governor-General has been pleased to approve the following appointments, promotions, and terminations of appointments in the Royal New Zealand Navy:

Lieutenant Commander K. H. J. L. Phibbs, short-service commission terminated, released to date 18 July 1954. Reverted to R.N. Retired List, to date 19 July 1954.

Lieutenant Commander (L) L. B. Carey, promoted to rank of Commander (L) to date 30 June 1954.

Lieutenant R. H. L. Humby promoted to rank of Lieutenant Commander, to date 28 August 1954.

Acting Lieutenant T. A. Riddell confirmed in rank of Lieutenant with original seniority of 16 July 1953.

Surgeon Lieutenant J. D. Read, M.B., Ch.B., granted a further short-service commission of four and a half years from 9 August 1954, and appointed H.M.N.Z.S. Maori, additional, for passage to United Kingdom for post-graduate training, to date 15 September 1954.
